What Changed in New York Injury Law on May 26, 2026

Read this first, because most of what is written online about New York injury claims is now out of date. Part EE of Chapter 58 of the Laws of 2026 rewrote the auto injury rules, and the timing catches people out: the amendments apply to actions commenced on or after May 26, 2026, not to accidents on or after that date. Someone hurt last year who has not yet filed is under the new rules.

  • A serious injury category was repealed. The category that let a claim proceed where an injury prevented usual daily activities for part of the first six months is gone from Insurance Law § 5102(d). Eight categories remain: death; dismemberment; significant disfigurement; a fracture; loss of a fetus; permanent loss of use of a body organ, member, function or system; permanent consequential limitation of use of a body organ or member; and significant limitation of use of a body function or system. Proof now has to be objective.
  • A 50 percent fault bar was added. New CPLR 1411(b) provides that in a motor vehicle case governed by Insurance Law Article 51, a claimant more than 50 percent at fault may be barred from recovery entirely. Its exact scope has not yet been tested in the courts.
  • Fault is decided first. Under amended Insurance Law § 5104, the trier of fact must determine fault before reaching the question of serious injury. New § 5104(d) also caps non-economic loss at $100,000 for certain at-fault drivers who were uninsured, convicted of an impaired-driving offense, or convicted of a felony arising from the crash.

One thing did not change, and it matters. Pure comparative negligence under CPLR 1411(a) still governs every non-auto case — slip and fall, trip and fall, premises liability, construction, dog bite. In those cases being partly at fault reduces your recovery; it does not bar it. When an adjuster on a fall claim tells you that you should have watched where you were going and therefore have no case, that is not New York law.

Separately, NYC Taxi and Limousine Commission required no-fault dropped from $200,000 to $100,000 per person on March 1, 2026 under Local Law 90 of 2025, for taxis, for-hire vehicles, luxury limousines and street hail liveries. And one change that has nothing to do with cars. On April 17, 2025 the Court of Appeals decided Flanders v Goodfellow, which overruled Bard v Jahnke and restored the ordinary negligence claim against a dog owner in New York. Why Fresh Meadows Streets Produce the Crashes They Do

The Fresh Meadows development built by New York Life between 1947 and 1962, designed by Ralph Thomas Walker, was among the first communities in the United States laid out for the automobile rather than the pedestrian. Its internal streets are Circles, Crescents and Lanes, curved deliberately to keep through traffic out. It worked. The consequence is that every through trip is pushed onto the ring of arterials, and that is where people get hurt.

  • 188th Street and 73rd Avenue is a designated NYC DOT Vision Zero Priority Intersection.
  • On the 188th Street corridor between the Horace Harding Expressway and 73rd Avenue, 2012 through 2016, NYC DOT recorded 77 total injuries: 24 pedestrian injuries including 2 severe and 1 fatality, 2 cyclist injuries, and 51 motor vehicle occupant injuries.
  • On Utopia Parkway, across 2.6 miles from the Grand Central Parkway to Northern Boulevard, 2023 brought 61 reported crashes and 27 people injured.
  • Francis Lewis Boulevard through Cunningham Park is known locally as “the Franny Lew Speedway,” long associated with street racing. Speed cameras there run 24 hours a day, under a program authorized through 2030.
  • Union Turnpike along the southern boundary is four lanes split by a narrow concrete median, which leaves little room to recover from a mistake.

The wider trend is genuinely good news, and worth stating honestly: New York City recorded 205 traffic deaths in 2025, the lowest since record-keeping began in 1910, and Queens fell from 74 deaths in 2024 to 57. Fewer people are being killed. Tens of thousands are still being injured, and those are the cases that come to us.

  • 90 days — and a different address — a claim against the New York City Transit Authority runs on Public Authorities Law § 1212, and it is served on NYCT Department of Law – Claims, 130 Livingston Street, Brooklyn, not on the Comptroller. Suit follows within one year and 90 days. The MTA Bus Company is exempt from the notice of claim but requires a § 1276(1) demand and a 30-day wait.
  • 2 years — wrongful death under EPTL 5-4.1. Damages remain limited to pecuniary loss; the Grieving Families Act was vetoed four times, most recently on December 5, 2025, and is not law.
  • 3 years — personal injury under CPLR 214(5).

The 90-day trap is the one to watch. If a City vehicle was involved, if a defective roadway or malfunctioning signal contributed, or if you fell on a sidewalk abutting an owner-occupied one-, two- or three-family house, the City may be the defendant — and 90 days runs out while you are still in physical therapy. Evidence has its own clock, shorter than any of these: store and street cameras commonly overwrite within one to four weeks.

It turns on when the lawsuit is commenced, not when you were hurt. The amendments apply to actions commenced on or after May 26, 2026. If you were injured last year and have not yet filed, a suit filed now falls under the new rules, which makes the timing of filing a strategic decision in itself.

Can I still recover if the accident was partly my fault?

It depends entirely on the type of case. In a motor vehicle case, CPLR 1411(b) means a claimant more than 50 percent at fault may be barred from recovering at all. In every non-auto case — a fall, a construction injury, a dog bite — pure comparative negligence still applies, so your share of fault reduces the award and nothing more.

What does no-fault actually pay?

Basic economic loss is capped at $50,000 per person: medical treatment, lost earnings up to $2,000 per month for up to three years subject to a 20 percent statutory offset, and other reasonable and necessary expenses up to $25 per day for a year. It pays nothing for pain and suffering. A TLC-licensed vehicle carries $100,000 in personal injury protection instead of $50,000.
