It is a for-hire vehicle licensed by the NYC Taxi and Limousine Commission. The driver needs a TLC driver license, the car carries TLC plates, and it must carry commercial for-hire insurance.
That means the TLC’s insurance minimums govern a Lyft ride that starts in Queens, not the state’s separate rideshare law. You may see a much larger number quoted online, but New York State’s rideshare insurance rule does not apply inside New York City, which is left to the TLC. The required coverage for a for-hire vehicle with fewer than eight seats looks like this:

A crash before March 1, 2026 may still fall under the PIP policy then in force. And any Lyft coverage above the minimums has to be confirmed from the insurer and the trip record; we do not guess at those numbers.

New York is a no-fault state under Insurance Law Section 5102, so the first money for medical care and lost pay usually comes from Personal Injury Protection. Where you were when the crash happened decides which policy you start with.
You were riding in the Lyft
Passengers generally claim PIP from the vehicle they were in, which means the Lyft car’s commercial policy. The application goes to that insurer within 30 days. If the Lyft driver or another motorist caused the crash and your injury meets the serious-injury definition, a liability claim can follow. Riders are rarely blamed for a crash, so the new fault cutoff described below seldom affects a passenger’s case.
A Lyft car hit you while you were walking or biking
Pedestrians and cyclists generally claim PIP from the vehicle that struck them. Here the 2026 fault rule matters, because the insurer will look hard at where you crossed and whether you had the signal.
You were driving another car
Drivers usually start with the no-fault coverage on their own vehicle, then look at a liability claim against the Lyft driver and owner if the injury qualifies. If the other driver was at fault and has little insurance, your own supplementary uninsured/underinsured motorist (SUM) coverage, or a household relative’s, may become important.
You were the Lyft driver
Lyft drivers in New York City who are hurt on the job are generally covered for their own work injuries through the New York Black Car Fund, a workers’ compensation system for black-car and app-based for-hire drivers. That is separate from a passenger’s claim.
What to Save From the Lyft App, Starting Tonight
A yellow cab has a medallion number painted on the side. A Lyft ride lives mostly on your phone, and that record is the backbone of the case. Before you do anything else, work through this list:
- Screenshot the ride receipt. It shows the trip ID, the date, and the start and end times.
- Capture the driver’s name, photo and plate exactly as the app displayed them.
- Save the route map so the location of the crash along the trip is clear.
- Report the crash in the Lyft app through its safety or help feature, and keep a copy of anything you submit.
- Call the police and get the report number. Where required, crash reports also go to the New York DMV.
- Do not delete the app or your account, even if you never want to ride again.
One more detail matters: the driver’s status at the moment of impact. Was the app off, was the driver waiting for a request, heading to a pickup, or carrying a passenger? The answer can affect which insurance is in play, and it often comes from the trip data and the insurer rather than from anything you can see. That is one of the first things we request.
The 2026 Rule Changes, in Plain Terms
New York rewrote several pieces of car-accident law this year. If you read older articles, some of what they say is no longer accurate.
A tighter serious-injury definition
No-fault does not pay for pain and suffering. To pursue that, you need a “serious injury” under Insurance Law 5102(d). The 2026 budget removed one of the old categories, leaving eight:
- Death
- Dismemberment
- Significant disfigurement
- Fracture
- Loss of a fetus
- Permanent loss of use of a body organ, member, function or system
- Permanent consequential limitation of use of a body organ or member
- Significant limitation of use of a body function or system
Fault is decided first, and too much fault ends the case
Under the new CPLR 1411(b), in a motor-vehicle injury lawsuit under Insurance Law Article 51 commenced on or after May 26, 2026, a claimant whose fault is greater than the defendant’s (or the defendants’ combined) recovers nothing. At 50% or less, the recovery is reduced in proportion. Insurance Law 5104 now has the fact-finder decide fault before serious injury, and new Section 5104(d) caps non-economic damages at $100,000 for certain at-fault claimants, such as one convicted of impaired driving. Per DFS Circular Letter 2026-01, these rules apply to suits filed on or after May 26, 2026, whenever the crash happened.
For a Lyft passenger, the fault rule is rarely the problem. For the person on foot or on a bike outside the car, it can be the whole case. That is why we move quickly on scene evidence.

Brookville Park is where Rosedale goes outside. The city park runs along Brookville Boulevard, with ball fields, playgrounds and walking paths that draw families, youth teams and dog walkers, especially on weekends. To the west, Idlewild Park Preserve protects marsh and wetland at the edge of the airport; its name recalls Idlewild, the airport’s original name.
