Taxi Accident Lawyer Glendale

Glendale is a quiet place by Queens standards. It is a neighborhood of attached brick houses, side streets lined with parked cars, cemeteries and parkland, and a handful of busy corridors that carry most of the traffic through it. Yet yellow cabs, green Boro Taxis, app-based cars and car services move through Glendale every day, picking up shoppers at Atlas Park, dropping off patients and visitors, and cutting between Brooklyn, Forest Hills and the Jackie Robinson Parkway. When one of those vehicles causes a crash, the injured person faces a set of rules that is different from an ordinary car accident, and in 2026 several of those rules changed. If you were hurt in or by a taxi in Glendale, this page explains, in plain terms, how a claim works and what our firm can do for you.

Yakov Mushiyev & Associates, P.C. represents people injured in taxi, for-hire vehicle and rideshare accidents throughout Queens. We offer consultations in English, Russian and Spanish, we can meet you at home, in the hospital or by video, and you pay no fee unless we win. If you prefer to read first, read on. If you would rather talk, call 718.775.3110.

Why a Taxi Accident in Glendale Is Not an Ordinary Fender-Bender

A collision with a private car usually involves one driver, one insurance policy and one set of facts. A taxi or for-hire crash adds layers. The vehicle is licensed by the New York City Taxi and Limousine Commission, it carries insurance set by TLC rules rather than only the state minimum, and the driver may be working for a medallion owner, a base or an app company. Each of those parties can matter to who pays and how much.

There is also the question of who you were in the crash. A passenger in the back seat of the cab, a driver of another car, a cyclist on Cooper Avenue and a pedestrian crossing Myrtle Avenue all start their claims in different places. Getting that starting point right in the first few weeks shapes everything that follows.

Who Pays After a Glendale Taxi Crash

New York is a no-fault state. That phrase confuses many people, so it is worth being precise about what it means. Under Insurance Law § 5102(a), personal injury protection, usually called PIP or no-fault, pays medical bills, lost earnings and other basic economic loss regardless of who caused the crash. It does not pay for pain and suffering. For that, you need a separate claim against the at-fault driver, and that claim is subject to the serious injury threshold discussed below.

Which no-fault policy applies to you

  • Taxi or for-hire passengers generally claim no-fault benefits from the vehicle they were riding in.
  • Pedestrians and cyclists generally claim from the vehicle that struck them.
  • Drivers of other cars typically go through their own policy for no-fault, then pursue the taxi’s liability coverage for injury beyond that.

How much coverage a taxi carries

The state minimum PIP is $50,000 per person. TLC-licensed vehicles, which include yellow and green taxis, for-hire vehicles, Uber and Lyft cars and limousines, have historically been required to carry more. That requirement was cut from $200,000 to $100,000 per person, effective March 1, 2026, under a TLC rule implementing Local Law 90 of 2025. For medallion taxis, TLC also requires liability coverage of at least $100,000 per person and $300,000 per occurrence. These are minimums; the actual policy on a given vehicle may differ, which is one reason we obtain the policy information early.

CoverageWhat it paysCurrent figure
State minimum PIP (most private cars)Medical, lost earnings, basic economic loss$50,000 per person
PIP on TLC-licensed vehiclesSame, regardless of fault$100,000 per person (since March 1, 2026)
Medallion taxi liability minimumPain and suffering and losses beyond no-fault, when the driver is at fault$100,000 per person / $300,000 per occurrence

Our car accident practice page covers the general no-fault framework in more depth.

The 2026 Changes Every Glendale Claimant Should Understand

The 2026 state budget (Chapter 58, Part EE) rewrote several pieces of New York motor-vehicle injury law. I want to walk through them carefully, because older articles online still describe the previous rules.

The serious injury threshold now has eight categories

To recover for pain and suffering after a car or taxi crash, you must show a “serious injury” as defined in Insurance Law § 5102(d). The budget removed one category that used to exist, the one based on being unable to perform daily activities for a set number of days. What remains are eight categories:

  1. Death
  2. Dismemberment
  3. Significant disfigurement
  4. Fracture
  5. Loss of a fetus
  6. Permanent loss of use of a body organ, member, function or system
  7. Permanent consequential limitation of use of a body organ or member
  8. Significant limitation of use of a body function or system

In practice, this puts more weight on medical documentation. Imaging, specialist findings and consistent treatment records matter more than ever when the claim rests on a limitation-of-use category.

A new fault rule for motor-vehicle cases

Under new CPLR 1411(b), in motor-vehicle injury actions under Insurance Law Article 51 commenced on or after May 26, 2026, a claimant whose share of fault is greater than the defendant’s (or the defendants’ combined share) recovers nothing. A claimant who is 50% or less at fault has damages reduced in proportion. This applies to lawsuits filed on or after May 26, 2026, regardless of when the accident happened. Claims that are not motor-vehicle claims remain under the comparative fault rule of CPLR 1411(a).

Insurance Law § 5104 now also requires the fact-finder to decide fault before deciding whether the injury is serious, and new § 5104(d) caps non-economic damages at $100,000 for an at-fault claimant who was driving uninsured (with an exception for a lapse under 30 days that was not the claimant’s responsibility), was convicted of impaired driving, or was convicted of a felony committed while driving. That cap does not limit economic damages, other people’s claims or wrongful death claims. The Department of Financial Services addressed these changes in Circular Letter 2026-01.

Because fault is now decided first, and because being found more at fault than the other side ends the claim, the early evidence about how the crash happened has become as important as the medical evidence about what it did to you.

We wrote a companion article on how these changes play out depending on whether you were a passenger or on foot: Glendale taxi accident claims for passengers and pedestrians.

Deadlines That Cannot Be Missed

In taxi cases, missed dates can do more damage than difficult facts. These are the deadlines that matter:

  • 30 days from the accident to file the no-fault application (11 NYCRR 65-1.1). Missing it can jeopardize payment of your medical bills and lost wages.
  • 90 days to serve a notice of claim if a City or MTA vehicle was involved (General Municipal Law § 50-e). An MTA bus on Myrtle Avenue is a common example.
  • 3 years to file a personal injury lawsuit under CPLR 214(5).
  • 2 years for a wrongful death action under EPTL 5-4.1, which allows recovery of pecuniary (financial) losses only. The Grieving Families Act, which would have expanded that, was vetoed for a fourth time in December 2025.

A police report is helpful, and you can also file your own MV-104 accident report through the New York State DMV when the law requires it. Our general FAQ page answers more procedural questions.

Where Taxi Crashes Happen in and Around Glendale

Every neighborhood has its pressure points. In Glendale they tend to sit along the commercial avenues and at the edges where local streets meet faster roads. Anyone who drives or walks here will recognize these:

  • Myrtle Avenue. Glendale’s main shopping street carries buses, double-parked delivery trucks and cars pulling in and out of curbside spaces. A cab stopping abruptly for a hail, or a passenger opening a door into traffic, is a familiar hazard.
  • Cooper Avenue. It links Glendale toward Ridgewood and Middle Village and runs past Atlas Park. Drivers turning into and out of the shopping center’s parking areas meet through traffic here.
  • Woodhaven Boulevard. A wide, fast arterial on Glendale’s eastern side and a main route between Queens Boulevard and the south. Speed and lane changes are the concern.
  • Metropolitan Avenue. A through route at the neighborhood’s northern edge toward Middle Village and Forest Hills.
  • The park edges and Forest Park Drive. Winding roads with joggers, cyclists and drivers looking for parking near the park’s entrances.

Glendale also borders neighborhoods with their own traffic patterns. If your crash happened just over the line, see our pages for a taxi accident lawyer in Ridgewood or a taxi accident lawyer in Forest Hills.

Forest Park and The Shops at Atlas Park: Glendale’s Two Destinations

Forest Park is one of the largest parks in Queens, a wooded stretch that runs from Glendale and Woodhaven toward Kew Gardens, Forest Hills and Richmond Hill. On the Glendale side, people come for ballfields, walking and running paths and the woods themselves. Weekend sports and warm-weather evenings bring families and leagues, and with them a steady stream of drop-offs and pickups along the park’s edges and on Forest Park Drive. Drivers slowing to read signs, cars pulling over without signaling and pedestrians crossing between parked cars to reach an entrance all create risk.

The Shops at Atlas Park is an open-air shopping and dining center on Cooper Avenue near 80th Street. It draws shoppers from Glendale and the surrounding neighborhoods, along with moviegoers and diners in the evening. Because Glendale has no subway station of its own, many visitors arrive by car, bus, cab or app-based ride, and those rides concentrate at the center’s curbs and driveways. The common patterns we look at in an Atlas Park case include:

  • Rideshare and car-service drivers stopping in travel lanes on Cooper Avenue to meet a passenger.
  • Left turns into and out of the center across oncoming traffic.
  • Pedestrians carrying bags, walking between parked cars to reach a waiting vehicle.

A crash in a private parking area can raise questions about property ownership and security video that do not come up on a public street. Video from businesses is often overwritten quickly, so if your accident happened at or near Atlas Park, early contact matters.

How We Handle a Glendale Taxi Accident Claim

The work generally moves in this order:

  1. Free review. We listen, ask what happened, and tell you honestly whether we think we can help.
  2. No-fault protection. We make sure the application goes to the correct insurer within 30 days, so your treatment and lost wages are covered while the case proceeds.
  3. Evidence. We identify the vehicle’s TLC license and insurer, request police reports, seek video from businesses on Myrtle Avenue or Cooper Avenue, and locate witnesses.
  4. Medical documentation. We work with your doctors to document your injuries in terms that match the serious injury categories.
  5. Negotiation. We present the claim to the liability insurer with the facts and records that support it.
  6. Litigation if needed. When an insurer will not be fair, we file suit in Queens County Supreme Court, mindful of the fault rules that apply to cases filed after May 26, 2026.

Taxi Accident FAQs

I was a passenger in a cab. Whose insurance pays my medical bills?

Generally, a passenger claims no-fault benefits from the vehicle he or she was riding in. For a TLC-licensed vehicle, the required PIP is now $100,000 per person. If your injuries meet the serious injury threshold, you may also have a claim against whichever driver was at fault, which might be the cab driver, the other driver, or both.

I was hit by a taxi while walking. Do I use my own car insurance?

Pedestrians and cyclists generally claim no-fault benefits from the vehicle that struck them. Your own policy can come into play in some situations, so bring any insurance cards you have to the consultation.

Is an Uber or Lyft crash treated the same as a yellow cab crash?

App-based vehicles in New York City are TLC-licensed, so the TLC insurance rules, including the $100,000 PIP requirement, apply to them. Whether the driver had a trip in progress and which company’s coverage responds are questions we investigate in each case.

How long do I have to file a lawsuit?

Three years for personal injury under CPLR 214(5), and two years for wrongful death. But the no-fault application is due within 30 days, and claims involving a City or MTA vehicle require a notice of claim within 90 days.

What if I was partly at fault?

For motor-vehicle injury lawsuits filed on or after May 26, 2026, a claimant who is 50% or less at fault has damages reduced proportionally; a claimant found more at fault than the defendants recovers nothing. That makes an honest, early look at the facts essential.

Do I need a “serious injury” to recover anything?

No. No-fault benefits pay medical bills and lost earnings without that showing. The serious injury threshold applies to the separate claim for pain and suffering and other non-economic loss.

Should I talk to the taxi company’s insurer?

You should report the accident as required, but you are not obligated to give a recorded statement to the other side’s insurer. It is wise to speak with a lawyer before you do.

About Glendale: Local FAQs

What neighborhoods border Glendale?

Glendale sits between Ridgewood to the west, Middle Village to the north, Forest Hills to the east and Woodhaven to the south, with Forest Park along its southeastern edge and Brooklyn’s Cypress Hills to the southwest.

Is there a subway station in Glendale?

No. Residents usually rely on buses along Myrtle Avenue and other corridors, or travel to the M train at Middle Village–Metropolitan Avenue in neighboring Middle Village. That reliance on buses, cabs and app rides is one reason for-hire traffic is steady here.

What ZIP code covers Glendale?

Glendale is served by ZIP code 11385, which it shares with Ridgewood.

Which police precinct handles accidents in Glendale?

The NYPD’s 104th Precinct covers Glendale along with Ridgewood, Middle Village and Maspeth. Accident reports for crashes in the neighborhood are generally prepared by officers from that precinct.

Where would a Glendale injury lawsuit be filed?

Glendale is in Queens County, so a personal injury lawsuit arising here would typically be filed in the Supreme Court, Queens County, whose civil term sits on Sutphin Boulevard in Jamaica. The New York State Unified Court System site has court locations and information.

Which hospitals are close to Glendale?

Nearby hospitals include Jamaica Hospital Medical Center in Richmond Hill and Wyckoff Heights Medical Center on the Ridgewood–Bushwick border. In an emergency, EMS decides where to take you.

Any tips for getting a cab or app ride safely around Atlas Park?

Pick a meeting point where the car can pull fully out of the travel lane, avoid crossing mid-block between parked cars, and exit on the curb side. If a crash does happen, photograph the vehicle’s TLC license number and plates.
