1. No-fault insurance on the car
If a driver on Queens Boulevard near Queens Center or along Broadway struck you, the first payer is usually the car’s own insurance. New York treats you as a “non-occupant” of that vehicle, and Insurance Law § 5103 generally lets you collect no-fault benefits for medical treatment and a portion of lost income. 2. The driver’s bodily injury policy
No-fault does not pay for pain, lost enjoyment of life, or the full wage loss. For that, you look to the driver’s liability insurance. New York generally requires a “serious injury” before you can bring that kind of claim, such as a fracture or a significant limitation of a body part, as defined in Insurance Law § 5102. A broken wrist or collarbone, which is common when a rider goes over the handlebars, often meets that bar.

3. Your own policies when the driver is gone or uninsured
Some drivers don’t stop. Others have no insurance at all. If that happened to you, you still have options. If you or a relative you live with has car insurance, the uninsured motorist part of that policy may respond. If no household policy exists, the Motor Vehicle Accident Indemnification Corporation (MVAIC) may step in. The deadlines here are short and strict, so tell us early. 4. Workers’ compensation for delivery riders
A lot of riders around Elmhurst are working when they get hurt, carrying food from Broadway restaurants to the large apartment buildings off Justice Avenue. A defective bike or battery can support a product liability claim against the maker or seller. Please don’t repair or throw away the bike. It is often the single most important piece of proof.
6. The city, when the street itself is the hazard
A deep pothole or a broken bike-lane barrier can throw a rider just as easily as a car can. Claims against the city are possible, but General Municipal Law § 50-e generally requires a notice of claim within 90 days. That is a tight window, so photograph the spot before it gets patched.
What about everyday deadlines?
Beyond the 30-day no-fault filing and the 90-day city notice, most injury lawsuits in New York generally have to be started within three years.
