The honest answer depends on the injuries and the insurers involved, but most claims move through a recognizable sequence. The account below follows that sequence from the day of the collision through a possible trial, noting at each phase what the law requires and what the injured person can do.
Day 1: the collision and the first record
The first day sets the evidentiary foundation for everything that follows. Police should be called so that a report is prepared, and the report number recorded. Photographs of the vehicle, its plate, the bike’s final position, traffic controls and the road surface should be taken if it is safe to do so. Witness names and telephone numbers are worth more on day one than at any later point.
Medical evaluation belongs on the same day. Head and brain injuries, fractures of the wrist, collarbone and leg, spinal injuries, facial and dental trauma, and road rash are the injuries most associated with e-bike crashes, and several of them can present with delayed symptoms. A same-day record connects the injury to the event.
The bike, battery and helmet should be set aside in their post-crash condition. Nothing should be repaired or discarded.
Week 1: preserving what disappears
The first week is a race against automatic deletion. Surveillance video from businesses, buses and residential doorbell cameras is routinely overwritten within days, so preservation requests should go out immediately. For delivery riders, app trip data from the ride in progress should be secured as well.

Month 1: the short statutory deadlines
Several of the most consequential deadlines fall within the first month or shortly after.
- No-fault application. Where a motor vehicle struck the rider, the vehicle’s no-fault coverage generally pays medical expenses and part of lost wages for a non-occupant (Insurance Law § 5103). That filing is generally due within 30 days. See our no-fault guide.
- Hit-and-run or uninsured driver. Uninsured motorist coverage under the household auto policy, or MVAIC, may apply, subject to strict early deadlines.
- Workers’ compensation. Employees generally receive workers’ compensation; app-based riders may be classified as independent contractors, which affects benefits. A separate claim against a negligent driver may exist. Our work injury practice coordinates both.
- Claims against the city. If a pothole or broken roadway caused the crash, a notice of claim generally must be served within 90 days under General Municipal Law § 50-e. That window closes before the end of month three.
Months 3 to 12: treatment, valuation and negotiation
With the urgent filings made, attention shifts to the medical picture. A claim against the driver for pain and suffering generally requires a “serious injury” under Insurance Law § 5102(d), such as a fracture or significant limitation of use of a body function. That determination rests on treating records, imaging and specialist opinions, so the case is usually not valued until treatment has progressed far enough to show the extent of any lasting harm.

Many claims resolve by negotiation somewhere in this window. Others do not, and a lawsuit is filed.
Trial: when agreement is not reached
Most personal injury actions in New York generally must be commenced within three years of the crash (CPLR § 214), and filing well before that limit preserves options. Litigation brings exchange of documents, depositions and, in contested cases, testimony from an accident reconstructionist. Cases can still settle at any stage, including on the eve of trial. If they do not, a jury decides fault and damages.
If you were walking, not riding
A person on foot struck by an e-bike follows a somewhat different timeline. Because an e-bike is not a motor vehicle, no-fault generally does not apply to it, and the claim is directed at the rider and, depending on the facts, possibly a homeowners or renters policy (terms vary) or a business responsible for the rider.
