Stranded on the Mall Is Not Your Fault
The recurring Queens Boulevard fact pattern is someone caught partway across when the signal changes, then struck stepping off the mall as traffic starts moving. The insurer’s framing is always the same: you crossed against the light.
New York’s Vehicle and Traffic Law requires drivers to yield to pedestrians in marked crosswalks and at unmarked crosswalks at intersections. Separately, VTL § 1146 imposes a duty on every driver to exercise due care to avoid striking a pedestrian — whether or not you were in a crosswalk, and whether or not the signal had changed. A driver who accelerates into someone plainly still in the roadway has not exercised due care.
And under pure comparative negligence (CPLR 1411), even if you did misjudge the crossing, that reduces recovery by a percentage rather than defeating it.
You Get No-Fault Benefits Without a Car
A pedestrian struck by a motor vehicle is generally entitled to no-fault benefits — medical treatment and part of lost earnings — regardless of fault, usually through the insurer of the vehicle that hit them. No car of your own required, no policy required.
The application is due within 30 days. Pedestrians forfeit this more often than anyone, because no insurer has any reason to mention that the form exists. If the vehicle fled and was never identified, MVAIC may still provide a route on shorter notice terms.
If the Crossing Itself Was the Problem
Where signal timing, a failed pedestrian signal, a missing or faded crossing, obstructed sightlines across a mall, or a broken street light contributed, the City of New York may share responsibility.
That runs on a far shorter track: a Notice of Claim within 90 days under General Municipal Law § 50-e, suit within one year and 90 days, and generally a prior written notice requirement for the specific defect. The same 90-day clock applies if an MTA bus was involved. Against a private driver you have three years under CPLR 214.

The Queens Boulevard crossings account for the most severe injuries. Austin Street is the opposite profile — slower, denser, with constant crossing between shops and turning vehicles into a narrow street.
The blocks around the 71st Avenue and 67th Avenue stations concentrate people arriving and leaving on foot at fixed times, and the LIRR station adds its own flow. Metropolitan Avenue and Yellowstone Boulevard carry through traffic past residential frontage where people cross mid-block by habit.
What To Do
- Call 911. The police report and ambulance record anchor everything.
- Record exactly where you were — which roadway, which mall, which direction.
- Get the driver’s license, insurance and plate, or ask a bystander to.
- Go to the hospital and be examined properly.
- Photograph the vehicle’s damage and resting position — point of impact frequently contradicts the driver’s account.
- Note nearby cameras — buildings along the boulevard usually have them, and footage is gone within days.
