Pedestrian Accident Lawyer in Flushing, NY: One of the Busiest Corners in the City

Main Street and Roosevelt Avenue is one of the densest pedestrian environments anywhere in New York City. A subway terminus, a bus hub, an LIRR station and a shopping district all empty onto the same few blocks, and they do it all day.

You Get No-Fault Benefits Without Owning a Car
New York no-fault is not just for people in vehicles. A pedestrian struck by a motor vehicle is generally entitled to benefits — medical treatment and part of lost earnings — regardless of fault, usually through the insurer of the vehicle that hit them.
No car of your own required, no policy required. The application is due within 30 days. Pedestrians lose this more than any other group, because no insurance company has a reason to tell them the form exists.
If the vehicle fled and was never identified, MVAIC may still provide a route, on shorter notice terms.
A practical note for Flushing specifically: you do not have to speak English to make a claim, and you should not let a language barrier stop you from getting treatment documented or benefits filed. Interpreters can be arranged.
Turning Vehicles Are the Recurring Problem
In a dense grid the classic collision is not someone darting into traffic. It is a driver turning through a crosswalk into people who have the walk signal.
New York’s Vehicle and Traffic Law requires drivers to yield to pedestrians in marked crosswalks and at unmarked crosswalks at intersections. Separately, VTL § 1146 requires every driver to exercise due care to avoid striking a pedestrian — and that duty applies whether or not you were in a crosswalk.
Expect the insurer to argue you crossed mid-block or against the signal. Under pure comparative negligence (CPLR 1411), that reduces recovery by a percentage and never eliminates it.
If a Bus or City Vehicle Was Involved — 90 Days
Flushing is a major MTA bus terminus, so this comes up constantly. Claims against NYC Transit, the MTA, the City of New York or any public entity follow a much faster track:
- A Notice of Claim within 90 days under General Municipal Law § 50-e.
- Suit within one year and 90 days, not three years.
- A statutory hearing may be required first.
The same short clock applies where a City-maintained signal, street light or roadway condition contributed. Against a private driver you have the ordinary three years under CPLR 214.
The Threshold Rarely Stops These Claims
Pain and suffering requires clearing the “serious injury” threshold in Insurance Law § 5102(d). Between two vehicles that is fought hard. For a pedestrian it usually is not — an unprotected body against a vehicle produces fractures, and a fracture qualifies outright.
Watch for head injury. It is routinely missed in a brief emergency assessment and emerges over weeks as problems with memory, concentration, mood and sleep. Report every symptom, including the vague ones.
Where It Happens in Flushing
Main Street between Roosevelt and Northern carries the heaviest foot traffic, with constant double-parking and delivery activity narrowing sightlines. Roosevelt Avenue and Kissena Boulevard add turning conflict at every junction.
Northern Boulevard and College Point Boulevard are wider and faster, which changes the injury profile — fewer collisions, more severe ones. And the blocks around the transit hub see people crossing between bus stands and station entrances continuously.
What To Do
- Call 911. The police report and ambulance record anchor the claim.
- Get the driver’s license, insurance and plate, or ask a bystander to photograph them.
- Go to the hospital and be examined properly.
- Photograph where you were, where the vehicle stopped and its damage — point of impact often contradicts the driver.
- Note nearby cameras. In a dense retail corridor there are many, and footage is gone within days.
- Get witness numbers before the crowd disperses.
- Give no recorded statement before speaking with a lawyer.
