Road Rash and Scarring
What it means for you: Sliding across asphalt strips away skin. Mild road rash heals on its own. Deeper abrasions can get infected, need wound care, and leave scars or discoloration, especially on the face, arms and knees.
What it means for the claim: Scarring is visible and permanent, and New York law recognizes significant disfigurement as a type of serious injury. Photos taken as the wound heals, week by week, are some of the most persuasive proof we see. Take them even when you would rather not look.
Spinal Injuries
What it means for you: Back and neck injuries range from sprains to herniated discs to, in the worst cases, damage to the spinal cord. Pain may spread into an arm or leg, or you may notice numbness and weakness days after the fall.
What it means for the claim: These injuries are often argued over, because insurers like to blame older wear and tear. MRI results, a clear treatment history and a doctor who can connect the injury to the crash all matter. A significant limitation in how you use your body can qualify as a serious injury.

Who Pays the Medical Bills
This is the question families ask us most. When a car strikes a rider, the car’s no-fault insurance generally pays medical bills and part of lost wages, because the rider counts as a non-occupant under Insurance Law § 5103. The form is generally due within 30 days, so it should go out early. If a pedestrian was hurt by an e-bike, things work differently, because an e-bike is not a motor vehicle and no-fault generally does not cover the bike. If you were delivering food when you got hurt, workers’ compensation may be available depending on how you are classified.
Keep in mind that New York generally gives you three years to sue under CPLR § 214, but a claim against the city over a pothole needs notice within 90 days. And if you share some of the blame, CPLR § 1411 generally lets you recover a reduced amount.
