Scooter & E-Bike Accident Lawyer in Rosedale, NY

Hurt on a scooter, e-bike or moped? You need a scooter accident lawyer in Rosedale who gets how you actually ride: to the train, to work, on a delivery shift, or just to get around southeast Queens faster than the bus. Yakov Mushiyev & Associates handles scooter, e-bike and moped injury cases from our office at 1 Cross Island Plaza in Rosedale.

This page is short on fluff and long on answers. Scroll to your situation, see what we look at, and call when you're ready.

Your Situation → What We Look At

Every crash is different. But most of the calls we get fall into one of these buckets.

Your situationWhat we look at first
Rider hit by a carDriver fault, video, the driver's insurance, no-fault eligibility for your ride type, and any household auto policy
Rider hit by a doorWho opened it (driver or passenger), the parked car's position, the vehicle's insurance, and nearby cameras
Delivery worker on the jobWho you work for, workers' comp, a separate claim against the driver, and how benefits get coordinated
Battery fireThe battery, charger and device, certification marks, where it was bought, and the maker and seller
Rental scooterThe rental terms, trip data in the app, maintenance history, the company's coverage, and any driver involved
Pedestrian hit by a scooterThe rider's identity, any employer behind a delivery trip, homeowner's or renter's coverage, and your own health insurance

Below, each one in plain English.

Rider Hit by a Car

The driver still owes you care. Drivers must watch for smaller, quieter vehicles. Cutting you off, turning across you or passing too close are classic breaches.

Your ride type matters for insurance. New York defines e-bikes in Vehicle and Traffic Law § 102-c (three classes, with motor assistance ending at 20 or 25 mph) and e-scooters in § 114-e (under 100 pounds, top motor speed of 20 mph). E-bike and e-scooter riders hit by cars are often treated like cyclists for no-fault purposes. Faster mopeds can be treated more like motorcycles, which may cut off no-fault for the rider. Insurers love this fight. We gather the make, model and specs to win it.

No-fault, if it applies, generally pays medical bills and 80% of lost earnings up to $2,000 a month, within basic $50,000 coverage. The application is generally due within 30 days. Our New York no-fault claims guide has the details.

Pain and suffering needs a "serious injury." In car cases governed by no-fault, that means a fracture, significant disfigurement or a permanent or significant limitation under Insurance Law § 5102(d). The old 90/180-day category was removed in 2026.

Fault rules got stricter in 2026. In many vehicle cases, you now can't recover if you're found more at fault than the defendants combined. "The rider was speeding" is the insurer's favorite line. We answer it with video, damage patterns and specs.

Rider Hit by a Door

The door-opener is usually on the hook. New York law says you can't open a car door into moving traffic unless it's reasonably safe. That applies to drivers and passengers, including someone getting out of a cab or rideshare.

Who pays? Often the vehicle's insurance. We identify the vehicle, the owner, and whether the person was a passenger in a for-hire car with its own coverage.

What helps: photos of the door and the parked car, where you were riding, and any storefront or doorbell camera that saw it.

Delivery Worker on the Job

Two tracks, not one. If you're an employee, workers' comp generally covers medical care and part of your wages. Under Workers' Compensation Law § 11, comp is generally your only remedy against your own employer. But it doesn't protect the driver who hit you. You can usually bring that claim too.

App workers: The app may call you an independent contractor. That label isn't always the final word. Comp status depends on the facts, and it gets decided by the Workers' Compensation Board, not the app.

Deadlines: Tell your employer in writing within 30 days. File for comp (Form C-3) generally within two years.

Benefits overlap. Comp, no-fault and a lawsuit settlement interact, and comp may have a lien on your recovery. We map it out so nothing gets paid twice or left on the table. More on this in our guide to Grubhub and DoorDash delivery rider claims and on our Rosedale work injury lawyer page.

Battery Fire

No crash needed. Some of the worst injuries come from lithium-ion batteries that catch fire while charging. Burns and smoke injuries can be severe.

The claim is often against a company. A defective battery, charger or device can make the manufacturer, distributor or seller responsible. New York City requires e-bikes, e-scooters and their batteries sold or rented in the city to be certified to safety standards. NYC DOT's e-bike and e-scooter page urges riders to buy certified devices and use approved batteries and chargers.

Save everything. The battery, the charger, the box, the receipt, even the burned remains. Don't let a landlord or insurer throw them out. See our guide to e-bike fire injuries and lithium-ion battery claims.

Rental Scooter

Sign nothing new. After a crash, rental companies may send forms, releases or requests for a statement. Talk to us before you respond.

What we check: the rental agreement, the app's trip data (speed, route, timing), the scooter's maintenance history and whether a brake, throttle or wheel failed. If a car was involved, the driver's coverage comes into play too.

Keep screenshots of your ride history and any in-app messages.

Pedestrian Hit by a Scooter

Yes, you can have a claim. Riders must follow traffic rules and stay off sidewalks unless rules allow it. A rider who hits you can be responsible.

The money question. E-bikes and e-scooters usually don't carry auto insurance, so no-fault may not apply. We look for other coverage: the rider's homeowner's or renter's policy, and an employer if the rider was making a delivery. Your health insurance can cover treatment while the claim plays out.

Get the rider's info if you can, and note any business name on the bag or jacket.

Your First 48 Hours

Short list. Do what you can; we handle the rest.

  • See a doctor. Today. Tell them exactly how you crashed and what hurts, even if it seems minor.
  • Report it. Call 911 or report to the NYPD. In Rosedale, that's the 105th Precinct.
  • Photograph your ride. Make, model, serial number or VIN, any label showing class or speed, and every scratch.
  • Photograph the scene. The street, the car, the door, the pothole, whatever played a part.
  • Collect names. Driver, plate, insurance, witnesses.
  • Spot the cameras. Storefronts, doorbells, buses, dashcams. Write down where they are.
  • Stay off social media about the crash. Insurers read it.
  • Don't give a recorded statement to the other side's insurer before you talk to a lawyer.

Why Riders Hire a Local Firm

We can get to the scene fast. Our office is in Rosedale. Walking the block, photographing the corner and asking shop owners for footage happen in days, not weeks.

We know the border. Rosedale sits right on the Queens–Nassau line. A crash a few blocks east may involve Nassau County, the Town of Hempstead or a village, each with its own rules and notice deadlines. We check who owns the road before a deadline slips by.

We know how insurers treat riders. Expect them to argue about your ride's class, your speed and whether you belonged in that lane. As a former head litigation attorney, Yakov Mushiyev knows how those arguments get made, and how to answer them.

We speak your language. Literally. English, Russian and Spanish.

Scooter Accident Lawyer in Rosedale: How Your Case Moves

  1. Call. Free, confidential, in your language.
  2. Lock down evidence. Cameras, police report, witnesses, your ride.
  3. Get benefits flowing. No-fault or comp applications, filed on time.
  4. Find every policy. Driver, owner, employer, household, product maker.
  5. Build damages. Medical records, lost pay, the impact on your life.
  6. Negotiate. You approve every decision.
  7. Sue if needed. Typically in Queens County Supreme Court in Jamaica.

What You Can Recover

  • Medical costs not covered by no-fault or comp
  • Lost earnings, now and in the future
  • Pain and suffering, where the law allows
  • Your ride and gear

One 2026 catch: if you were operating a moped that had to be insured and wasn't, a new law may cap pain-and-suffering damages at $100,000 in some situations. It's technical. Ask us before you assume anything.

Near the Rosedale LIRR Station

Lots of local riders use a scooter or e-bike to cover the last mile to the train. That puts them in one of Rosedale's busiest spots.

The station sits where Sunrise Highway, Francis Lewis Boulevard and 243rd Street come together. Commuter drop-offs, cars pulling in and out, and drivers heading for the parkways all mix with riders trying to make a train. Doorings, right hooks and pull-out crashes are the risks here. Remember too that NYC caps e-bikes and e-scooters at 15 mph and limits them to bike lanes and streets posted at 30 mph or less, so insurers will ask exactly where and how fast you were riding. If you crashed near the station, tell us right away so we can chase nearby footage before it's gone.

Quick FAQ

I didn't have a helmet. Is my case dead?

Not necessarily. Helmets are required for some riders, like Class 3 e-bike riders and delivery workers, but injuries to your legs, arms or back have nothing to do with a helmet. We look at the medical evidence.

The driver drove off. Now what?

Report it to police quickly. You may have options through your household policy or MVAIC, with short deadlines. See our guide on uninsured motorist claims and MVAIC.

Is an e-bike accident lawyer different from a moped accident lawyer?

Same lawyer, different rules. We handle e-bikes, e-scooters and mopeds, and the first thing we do is pin down exactly what you were riding.

How much is my case worth?

Honest answer: it depends on your injuries, your treatment, your lost work, who was at fault and how much insurance is available. Anyone who quotes a number on the first call is guessing. We give you a realistic picture once the facts and medical records are in.

I ride a regular bike, not electric.
