The Columns Are Part of Your Case
A driver approaching a crossing on Roosevelt Avenue has their view of the far side interrupted by structural steel. A pedestrian stepping out has the same problem in reverse. Add the permanent shadow under the structure, the glare where daylight breaks through, and the noise of trains overhead masking an approaching vehicle, and you have an environment that produces collisions by design.
None of that excuses the driver. New York’s Vehicle and Traffic Law requires drivers to yield to pedestrians in marked crosswalks and at unmarked crosswalks at intersections, and VTL § 1146 separately requires every driver to exercise due care to avoid striking a pedestrian — crosswalk or not. A driver who cannot see past a column is required to slow down, not to proceed and hope.
It does mean sightline evidence matters more here than almost anywhere. Photographs taken from the driver’s approach position, at the same time of day, frequently show that the view was obstructed in a way no verbal account conveys.
You Get No-Fault Without Owning a Car
A pedestrian struck by a motor vehicle is generally entitled to no-fault benefits — medical treatment and part of lost earnings — regardless of fault, usually through the insurer of the vehicle that hit them. No car of your own required.
The application is due within 30 days. Pedestrians lose this more than anyone, because no insurance company has any reason to tell them the form exists. If the vehicle fled, MVAIC may still open a route on shorter notice terms.

Buses, City Vehicles and 90 Days
Roosevelt Avenue and Northern Boulevard carry heavy MTA bus traffic, and the 74th Street hub concentrates it. Where It Happens
Roosevelt Avenue accounts for the hardest cases, for the reasons above. 37th Avenue is the opposite — slower, denser, with constant crossing between shops and vehicles turning into a narrow street.
Northern Boulevard is wider and faster, which shifts the profile toward fewer but more severe collisions. And 82nd Street and the blocks around the 74th Street transit hub see people crossing between bus stands, station entrances and shops continuously, often carrying shopping and often mid-block.
Why the Threshold Rarely Bites
Pain and suffering requires clearing the “serious injury” threshold in Insurance Law § 5102(d). Between vehicles that is fought hard; for a pedestrian it usually is not, because an unprotected body against a vehicle produces fractures and a fracture qualifies outright.
Under pure comparative negligence (CPLR 1411), an argument that you crossed mid-block reduces recovery by a percentage and never eliminates it.
What To Do
- Call 911. The police report and ambulance record anchor everything.
- Photograph the sightlines — stand where the driver was and photograph what they could and could not see past the columns.
- Get the driver’s license, insurance and plate, or ask a bystander.
- Go to the hospital and be examined properly.
- Photograph the vehicle’s damage and resting position.
- Note nearby cameras — this corridor is densely covered, and footage disappears within days.
