It pays medical treatment and a share of lost wages, and it pays nothing at all for pain, suffering or the loss of what you can no longer do. That is the whole of it, and for a serious injury it is rarely enough.

What most injured warehouse workers are never told is that the exclusivity rule stops at their employer. Everyone else remains fully liable in negligence — and on a busy industrial site, everyone else is a long list:

  • The building owner, where the premises themselves were unsafe — a defective dock leveller, a broken dock lock, inadequate lighting, a damaged floor.
  • A different company’s driver who struck you, reversed into you, or pulled away from the dock while you were still working.
  • The equipment manufacturer or the maintenance contractor, where a forklift, pallet jack, conveyor or lift failed or lacked a required guard.
  • A staffing agency arrangement, where who your legal employer actually was is genuinely contestable.
  • The shipper or loader, where a badly secured or overloaded pallet or trailer caused the injury.

These third-party claims run alongside an open comp file, and pursuing one does not cost you comp benefits. Two comp deadlines still control: written notice to your employer within 30 days, and the C-3 claim form filed with the Workers’ Compensation Board within two years. Where the work involved construction, alteration or demolition rather than ordinary warehousing, the far stronger protections of Labor Law § 240 and § 241(6) may apply as well.

This is the single most valuable question to ask after a warehouse injury, and almost nobody asks it.

I work through a staffing agency. Who is my employer for this?

Contestable, and worth contesting. Where a worker is placed by an agency, the site company may or may not be a special employer entitled to comp protection — it turns on who directed and controlled the work. If the site company is not your employer in law, it is an ordinary negligence defendant. This is a fact-specific fight that has to be had early.

Will my employer be able to fire me for bringing a claim?

Retaliating against an employee for filing a workers’ compensation claim is unlawful in New York, and a third-party claim is not brought against your employer at all. If you are threatened over it, that is a separate problem with its own remedy — tell us rather than dropping the claim.

What should I preserve after a dock or forklift injury?

Photographs of the equipment and the exact location before anything is repaired or moved, the make and model and any serial or unit number, the names of everyone on shift, the incident report you were asked to sign, and any maintenance tag on the machine. Yard and dock camera footage is the most valuable item of all and typically the first to be overwritten.
