Lyft Accident Lawyer Kew Gardens

A Lyft crash in Kew Gardens raises a question that a crash in a private car usually does not: which set of insurance rules governs the trip? The answer is more specific than most people expect, and it shapes everything that follows, from who pays the first medical bill to how much coverage stands behind the driver. As a Lyft accident lawyer in Kew Gardens, Yakov Mushiyev & Associates, P.C. starts every case by pinning down that answer, because a claim built on the wrong rulebook loses time it cannot get back. If you were hurt as a Lyft passenger, as a pedestrian or cyclist struck by a Lyft car, or as a driver hit by one, call 718.775.3110 for a free case review. There is no fee unless we win.

Kew Gardens sits where several of the borough’s busiest roads converge. Queens Boulevard runs past Queens Borough Hall and the Queens criminal courthouse, Union Turnpike and Metropolitan Avenue cross the neighborhood, and the Kew Gardens Interchange gathers the Grand Central Parkway, the Van Wyck Expressway and the Jackie Robinson Parkway at its edge.

The Threshold Point: NYC Lyft Trips Run on TLC Rules

In New York City, a Lyft car is a for-hire vehicle licensed by the NYC Taxi and Limousine Commission. The driver holds a TLC driver license, the car carries TLC plates, and the vehicle must carry commercial for-hire insurance. That licensing status is what decides the coverage question.

New York State has a separate rideshare insurance law for transportation network companies. It requires $1.25 million in liability coverage while a passenger is aboard, but it exempts cities of one million or more people, so it does not govern trips that start inside New York City; it matters for a ride that begins outside the city, for example in Nassau County. For a trip that starts in Kew Gardens, the TLC minimums are the starting point:

Coverage on a TLC for-hire vehicle (under 8 seats)MinimumWhat it does
Bodily injury liability$100,000 per person / $300,000 per occurrencePays injury claims against the Lyft driver when the driver is at fault
Personal injury protection (no-fault)$100,000 per person since March 1, 2026Pays medical bills, part of lost earnings and other basic economic loss, regardless of fault
Additional coverage from LyftNot a fixed published figure for NYC tripsMay apply on some trips; has to be confirmed from the insurer and the trip record

Two details deserve precision. The TLC no-fault requirement was cut from $200,000 to $100,000 per person effective March 1, 2026, under a TLC rule implementing Local Law 90 of 2025. A crash before that date may still fall under the policy then in force. As for Lyft’s own coverage above the minimums, we confirm it from the insurer rather than assume it.

Where You Were Standing (or Sitting) Determines the Claim

Lyft passengers

A passenger generally claims no-fault benefits from the vehicle he or she occupied, which on a Lyft trip means the Lyft car’s commercial policy. Fault is rarely an issue for a passenger. If the injury meets the serious-injury threshold, a claim for pain and suffering can then run against whichever driver caused the crash, whether that is the Lyft driver, another motorist, or both.

Pedestrians and cyclists

Someone struck while crossing Queens Boulevard or riding along Metropolitan Avenue generally claims no-fault benefits from the vehicle that hit them. Here fault can become contested, and the 2026 fault rule discussed below matters most for pedestrians, cyclists and drivers.

Drivers of other vehicles

If a Lyft car hit you while you were driving, your own policy’s no-fault coverage generally pays first, and any injury claim beyond no-fault runs against the Lyft driver’s liability coverage. When the at-fault driver has little insurance, your own supplementary uninsured/underinsured motorist (SUM) coverage, or a household relative’s, may matter.

Lyft drivers themselves

A Lyft driver hurt on the job is generally covered for work injuries through the New York Black Car Fund, which is separate from any passenger’s claim. We wrote a full guide for drivers: hurt while driving for Lyft in Kew Gardens.

Evidence That Lives Inside the Lyft App

A yellow-cab crash leaves a medallion number and a meter. A Lyft crash leaves a digital record, and that record is often the cleanest evidence in the case. Preserve it in this order:

  1. Screenshot the ride receipt and trip details, including the trip ID, pickup and drop-off points, start and end times, and the route map.
  2. Capture the driver’s name and plate exactly as the app displayed them, and compare them with the car itself.
  3. Report the crash in the Lyft app through its safety reporting tools, and report it to the police as well.
  4. Do not delete the app or your account, even if you never plan to ride again.
  5. Note the driver’s status if you know it: app off, waiting for a request, en route to a pickup, or carrying a passenger. Status can change which coverage responds.
  6. Photograph the scene, including the service-road lane, signals, and where the car stopped relative to the curb.

Add medical evidence: a same-day emergency room or urgent care visit and consistent follow-up. Drivers involved in a crash may also have a duty to file an MV-104 report with the New York DMV; ask us whether it applies to you.

The 2026 Changes, Read Closely

New York rewrote several core auto-injury rules in 2026. They apply to Lyft cases like any other motor-vehicle case.

A narrower definition of serious injury

To recover for pain and suffering, a person hurt in a car crash generally must show a serious injury under Insurance Law § 5102(d). The 2026 state budget (Chapter 58, Part EE) removed one former category, leaving eight: death; dismemberment; significant disfigurement; fracture; loss of a fetus; permanent loss of use of a body organ, member, function or system; permanent consequential limitation of use of a body organ or member; and significant limitation of use of a body function or system.

Fault is decided first

Under Insurance Law § 5104, the judge or jury must now decide fault before deciding whether an injury is serious. A new § 5104(d) caps non-economic damages at $100,000 for an at-fault claimant who was driving uninsured through his or her own responsibility (a lapse of under 30 days is excepted), was convicted of impaired driving, or was convicted of a felony committed while driving. The cap does not limit economic damages, other people’s claims, or wrongful death claims.

A fault cutoff for motor-vehicle lawsuits

New CPLR 1411(b) applies to motor-vehicle personal injury actions under Insurance Law Article 51 commenced on or after May 26, 2026, regardless of the accident date. A claimant whose fault is greater than the defendant’s, or the defendants’ combined, recovers nothing. A claimant at 50% or less has the recovery reduced proportionally. Claims that are not motor-vehicle claims remain under CPLR 1411(a). The Department of Financial Services addressed these changes in Circular Letter 2026-01.

For a Lyft passenger, the new fault cutoff rarely bites. For a pedestrian on Queens Boulevard or a cyclist near Forest Park, an insurer now has every reason to argue that the injured person was more than half at fault. That argument should be answered with evidence gathered early.

Lyft Pickup Hazards Around Kew Gardens

We do not publish crash counts, and we will not guess at them. What we can describe is the street layout that tends to produce Lyft disputes in this neighborhood, based on how app-based pickups actually work:

  • Queens Boulevard service roads. A rider’s pin often lands on the main roadway while the car can only stop on the service road, or the reverse. Riders cross lanes to reach the car, and drivers cut across to reach the rider.
  • Union Turnpike at the subway station. Drivers pausing for riders leaving the E and F trains at Kew Gardens–Union Turnpike can be rear-ended or struck while merging back.
  • Lefferts Boulevard and Austin Street. Near the LIRR station the lanes narrow, deliveries double-park, and riders exit on the traffic side.
  • The Kew Gardens Interchange. Airport-bound trips merge quickly between the Van Wyck, the Grand Central and Union Turnpike, often while the driver is following turn-by-turn prompts.

Forest Park and the Borough Hall Courthouse Strip

Two destinations account for much of the Lyft traffic in and around Kew Gardens, and they produce very different pickup patterns.

Forest Park is one of the largest parks in Queens, with wooded trails, a golf course, a historic carousel, a bandshell used for summer concerts, and ballfields. Visitors arrive with strollers and bikes, which means longer curb stops. Lyft drop-offs tend to collect along Park Lane South and Metropolitan Avenue, and the Jackie Robinson Parkway runs through the park itself, so fast through traffic passes close to riders who are still unloading.

Queens Borough Hall and the criminal courthouse sit side by side on Queens Boulevard. On weekday mornings, jurors, witnesses, attorneys and families converge on a short stretch of curb with a fixed start time. Lyft cars stop wherever they can on the service road, riders step out quickly, and drivers pull back into a wide, fast boulevard to catch the next request. If you were hurt getting into or out of a Lyft near Borough Hall, the exact stopping point, the lane, and the time stamp on your receipt are worth recording while they are fresh.

Why Kew Gardens Clients Retain Mushiyev Law

Consistent treatment records support both the no-fault claim and the serious-injury showing. Photo: National Cancer Institute / Unsplash
  • We identify the right rulebook first. Trip origin, driver status and the vehicle’s TLC licensing decide which coverage applies.
  • We build the fault record early, because fault is now decided before serious injury.
  • We look at every policy: the Lyft car’s coverage, any other driver’s, and your own SUM coverage.
  • We meet you where you are: at home, in the hospital, or by video, in English, Russian or Spanish.
  • No fee unless we win.

Lyft Accident FAQs

Does the state’s rideshare insurance rule cover my Kew Gardens Lyft trip?

Generally no. That state rule exempts cities of one million or more people, so trips starting in New York City fall under the TLC minimums. It matters for rides that start outside the city, such as in Valley Stream or Elmont.

Which insurer gets my no-fault application as a Lyft passenger?

The insurer of the Lyft car you were riding in, under its commercial for-hire policy. File within 30 days of the accident.

Can I bring a claim against both the Lyft driver and the other driver?

Often, yes. When more than one driver contributed to the crash, a passenger who meets the serious-injury threshold may pursue each of them. We examine every available policy.

How much does Lyft itself carry on a New York City trip?

The TLC sets the minimums: $100,000 per person and $300,000 per occurrence in liability, and $100,000 per person in no-fault benefits since March 1, 2026. Lyft may carry additional coverage on some trips, but whether it applies, and how much, has to be confirmed from the insurer and the trip record.

I was crossing Queens Boulevard when a Lyft car hit me. Will my own fault be raised?

Expect it. Under CPLR 1411(b), for lawsuits filed on or after May 26, 2026, a claimant more at fault than the defendants recovers nothing. Signal timing, crosswalk position and witness statements become central.

Is there a Lyft accident attorney fee if the case is lost?

No. We work on a no-fee-unless-we-win basis, and the first review is free.

About Kew Gardens: Local FAQs

Which subway and rail stations serve Kew Gardens?

The E and F trains stop at Kew Gardens–Union Turnpike, and the Long Island Rail Road’s Kew Gardens station is near Lefferts Boulevard and Austin Street.

If I sue, will the case be heard at the courthouse next to Borough Hall?

Usually not. The courthouse beside Borough Hall handles criminal matters. Civil personal injury cases in Queens County Supreme Court are generally heard at the courthouse on Sutphin Boulevard in Jamaica. The New York State Unified Court System lists court locations, and the DFS auto insurance guide explains no-fault.

Is Kew Gardens the same neighborhood as Kew Gardens Hills?

No. Kew Gardens Hills is a separate neighborhood to the north. Kew Gardens itself borders Forest Hills to the west, Richmond Hill to the south and Briarwood to the east, with Forest Park along its southwest edge.

What ZIP code covers Kew Gardens?

Kew Gardens is served mainly by ZIP code 11415.

Where is the nearest hospital after a crash here?

Long Island Jewish Forest Hills is close by to the west, and Jamaica Hospital Medical Center is a short drive to the south and east. In an emergency, call 911 and go where EMS takes you.

Where should I set my Lyft pickup near Borough Hall?

Choose a spot on the service road curb rather than the main roadway, confirm the plate before you step toward the car, and exit on the curb side.
