If you were hurt riding an e-bike in Whitestone, you have probably already heard plenty of advice. A neighbor told you e-bike riders can’t sue. A cousin said the insurance company will sort it out. Someone online insisted that because you weren’t wearing a helmet, you’re out of luck. Most of that is wrong, or at least incomplete, and acting on it can cost you.

Myth 1: “An e-bike is a motor vehicle, so I’m treated like a driver.”
The reality: Under Vehicle and Traffic Law § 125, bicycles with electric assist are excluded from the definition of a motor vehicle. That matters more than it sounds. It shapes which insurance pays, and it means that when a car hits you, you’re generally treated as a non-occupant rather than as another motorist.

Myth 2: “My own insurance has nothing to do with this.”
The reality: When a car strikes you, it’s usually the car’s no-fault coverage that steps in first. Under Insurance Law § 5103, it generally pays your medical bills and part of your lost wages. You’ll want to file that application generally within 30 days.
Your own policies can still matter, though. If the driver sped off, or had no insurance, the uninsured motorist coverage on a household auto policy may apply. If there’s no such policy, MVAIC may be the route. Those claims come with strict, early deadlines, so please don’t sit on them.
Myth 3: “No helmet means no case.”
The reality: New York follows pure comparative fault under CPLR § 1411. Skipping a helmet, or riding a bit fast, may reduce what you recover. It doesn’t bar you from recovering. A driver who blew through a stop sign on 150th Street is still responsible for their share.

Myth 4: “I can sue the driver for pain and suffering no matter how badly I was hurt.”
The reality: Here the law is stricter than people expect. To go after a driver for pain and suffering, New York generally requires a “serious injury” as defined in Insurance Law § 5102(d). A fracture qualifies. So can a significant limitation in how a body part works. That’s why consistent medical care and good records matter so much; they’re what show the injury crosses that line.
Myth 5: “I have years, so there’s no rush.”
The reality: You generally do have three years to file a lawsuit under CPLR § 214. But several clocks run much faster. No-fault wants your application within about a month. And if a crumbling roadway or a pothole on the Clearview Expressway service roads caused your fall, a claim against the city needs a notice of claim within 90 days.
Evidence doesn’t wait either. Doorbell cameras on those blocks of single-family homes with yards tend to record over themselves. The sooner someone asks for that footage, the better your odds of getting it.
Myth 6: “If an e-bike hit me while I was walking, no-fault will cover me.”
The reality: Because an e-bike isn’t a motor vehicle, no-fault generally doesn’t apply to the bike itself. A walker hurt near Francis Lewis Park by a rider would look to the rider instead, and depending on the facts, possibly the rider’s homeowners or renters insurance (policies vary) or a business responsible for that rider. Myth 7: “A broken e-bike is just bad luck.”
The reality: Sometimes the machine is the problem. Brakes that fail. A battery that catches fire. NYC’s Local Law 39 of 2023 requires e-bikes sold, leased or rented in the city to meet UL 2849, and their batteries UL 2271. When a defect like that causes a crash, the company that built or sold the bike may be answerable in a product liability claim. Please hold on to the bike, unrepaired, so it can be examined.
