Auburndale Taxi Crash: The 60-Second Version

  • Medical bills first: New York is a no-fault state. No-fault (PIP) benefits pay medical costs and lost earnings no matter who caused the crash.
  • Taxis carry their own PIP: TLC-licensed vehicles must carry $100,000 per person in PIP as of March 1, 2026.
  • Pain and suffering needs more: To sue for pain and suffering, your injury generally has to meet New York’s “serious injury” threshold.
  • File for no-fault within 30 days. This is the deadline people miss most often.
  • Sue within 3 years in most injury cases. Much shorter if a city or MTA vehicle was involved.
  • Fault matters more now: In motor-vehicle lawsuits filed on or after May 26, 2026, a person found more at fault than the defendants recovers nothing.

Taxi Accident FAQs

These are the questions Auburndale callers ask us most. Each answer is kept short on purpose.

I was a passenger. Whose insurance pays my medical bills?

Usually the taxi’s. Passengers generally claim no-fault benefits from the vehicle they were riding in. For a TLC-licensed taxi or for-hire vehicle, that policy must carry $100,000 per person in PIP since March 1, 2026.

A cab hit me while I was walking or biking. Same rule?

No. Pedestrians and cyclists generally claim no-fault benefits from the vehicle that struck them. If a taxi hit you on Northern Boulevard, the taxi’s insurer is normally where your no-fault claim begins.

Does no-fault cover pain and suffering?

No. PIP covers basic economic loss: medical care, lost earnings and certain other out-of-pocket costs. Pain and suffering requires a separate claim against the at-fault driver, and that claim generally requires a “serious injury” as defined in Insurance Law § 5102(d).

What counts as a “serious injury” now?

After the 2026 state budget, the list has eight categories: death; dismemberment; significant disfigurement; a fracture; loss of a fetus; permanent loss of use of a body organ, member, function or system; permanent consequential limitation of use of a body organ or member; and significant limitation of use of a body function or system.

Can I still recover if I was partly at fault?

It depends on your share. Under new CPLR 1411(b), in motor-vehicle injury suits filed on or after May 26, 2026, a claimant found 50% or less at fault has damages reduced in proportion. A claimant found more at fault than the defendant (or all defendants combined) recovers nothing.

My crash happened before May 26, 2026. Do the new rules apply?

They can. The changes apply to lawsuits filed on or after May 26, 2026, regardless of when the accident happened. Timing of the filing matters, which is one reason to speak with a lawyer early.

Uber or Lyft hit me. Is that a “taxi” case?

For insurance purposes in New York City, often yes. Uber, Lyft and other for-hire vehicles are licensed by the NYC Taxi & Limousine Commission and fall under the same TLC PIP requirement as yellow and green cabs. Which policy applies can depend on the facts, so we confirm coverage in each case.

How much does it cost to hire you?

Nothing up front. The consultation is free, and there is no fee unless we win. You can see the kinds of matters the firm has handled on our settlements page.

Who Pays What: One Table

Your role in the crashNo-fault (PIP) usually comes fromPain and suffering claim against
Taxi or rideshare passengerThe taxi or for-hire vehicle you were inWhichever driver was at fault (could be the cab, the other car, or both)
PedestrianThe vehicle that struck youThe at-fault driver and owner
CyclistThe vehicle that struck youThe at-fault driver and owner
Driver of another carYour own auto policyThe taxi driver and owner, if they were at fault

Two numbers to know: TLC vehicles must carry $100,000 per person in PIP, and medallion taxis must carry at least $100,000 per person / $300,000 per occurrence in liability coverage. The general state minimum for PIP is $50,000 per person. For plain-English background on New York auto coverage, see the Department of Financial Services auto insurance page.

Deadlines at a Glance

  1. 30 days: file your no-fault application with the correct insurer.
  2. 90 days: serve a notice of claim if a New York City or MTA vehicle was involved (General Municipal Law § 50-e).
  3. 2 years: wrongful death actions, which in New York remain limited to pecuniary (financial) damages.
  4. 3 years: most personal injury lawsuits under CPLR 214(5).

Also file a police report or, where required, a report with the New York DMV (form MV-104). It creates a record that helps every later step.

What Changed in 2026

Three changes reshape taxi claims in Auburndale and across New York this year:

  • Lower taxi PIP. The TLC reduced required PIP for licensed vehicles to $100,000 per person, effective March 1, 2026. Serious medical bills can use that up, so other coverage matters more.
  • A shorter serious-injury list. The 2026 budget removed one category from § 5102(d), leaving eight. Medical documentation now carries even more weight.
  • Fault decided first. Under Insurance Law § 5104, the fact-finder decides fault before deciding serious injury. For claimants more at fault than the defendants, the case ends there in suits filed on or after May 26, 2026.

Under the 2026 rules, the fight over who caused the crash comes first. Evidence gathered in the first days often decides that fight.

One more change: a new $100,000 cap on non-economic damages applies to an at-fault claimant who was driving uninsured (with a narrow exception for a lapse of under 30 days), was convicted of impaired driving, or was convicted of a felony committed while driving. It does not cap economic damages, other people’s claims, or wrongful death. Most taxi passengers and pedestrians are not affected by it.

Where Auburndale Taxi Crashes Happen

Auburndale sits in northeast Queens between Flushing and Bayside, with Fresh Meadows to the south. It is mostly residential, but several busy corridors run through or along it. These are the places where cabs and app-based cars mix with local traffic:

  • Northern Boulevard: a wide commercial corridor with frequent stops, turning traffic and double-parked vehicles.
  • Francis Lewis Boulevard and Utopia Parkway: north-south routes that carry through traffic and cars heading to the expressways.
  • Clearview Expressway service roads: merging and exiting traffic on the eastern side of the neighborhood.
  • Long Island Expressway approaches: heavy traffic at the southern end, especially at rush hour.
  • The streets around Auburndale LIRR station: quick curbside pickups and drop-offs on narrow residential blocks.

Common crash patterns on these roads include sudden stops to pick up a fare, doors opened into cyclists, left turns across oncoming traffic, and drivers watching a ride-hail app instead of the road.

Top Destinations: Auburndale Station, Kissena Park and Flushing Meadows Corona Park

Auburndale LIRR station

What it is: a stop on the Long Island Rail Road’s Port Washington Branch, between Broadway (Flushing) and Bayside. Why people go: it is the neighborhood’s direct rail link toward Manhattan. Taxi pattern: riders getting off a train often step straight into a waiting car. Pickups and drop-offs cluster on the small streets next to the station, where drivers stop, pull out and turn quickly. Pedestrians crossing to the platform are the most exposed.

Kissena Park

What it is: a large park just west of Auburndale in Flushing, with a lake, ball fields and the Kissena Velodrome. Why people go: walking, cycling, sports and weekend gatherings. Taxi pattern: drop-offs along the park edges on weekends and evenings, with cyclists and families crossing nearby streets.

Flushing Meadows Corona Park

What it is: one of the city’s largest parks, home to the Unisphere, the Queens Museum and the USTA Billie Jean King National Tennis Center, with Citi Field next door. Why people go: the US Open, Mets games, museums and park events. Taxi pattern: Auburndale residents often get there by cab or app-based car. Event days bring heavy traffic, crowded drop-off zones and many drivers unfamiliar with the area. Crashes at congested pickup points after a game or match are a familiar scenario.

Right After the Crash: A Quick Checklist

  • Call 911 if anyone is hurt, and get checked by a doctor the same day if you can.
  • Write down the cab’s medallion number or the for-hire vehicle’s TLC plate and license number.
  • Take a screenshot of the trip in your Uber or Lyft app before it scrolls away.
  • Photograph the vehicles, the street, traffic signals and your injuries.
  • Get names and phone numbers of witnesses.
  • Do not give a recorded statement to the other driver’s insurer before getting advice.
