E-Bike Accident Lawyer Cambria Heights

Good claims get damaged by small errors. A deleted photo. A casual chat with an adjuster. A bike sent to the scrap pile. None of these feel like big decisions at the time. Each can cost real money later.

Below are eight mistakes we see after e-bike crashes on Linden Boulevard, Francis Lewis Boulevard, Springfield Boulevard and the side streets of Cambria Heights. Each comes with a fix. Our office is minutes away in Rosedale. Call 718.775.3110 if any of these already happened. Many can still be repaired.

What the scene looked like in the first minutes is often the strongest proof you will ever have.

Mistake 1: Leaving Without a Police Report

The driver seems nice. Apologizes. Offers cash. You both leave. Two days later, the story changes.

Instead: Call 911 from the scene. Get the report number. Record the driver’s name, plate, license and insurance. A police report fixes the basic facts before memories drift.

Mistake 2: Skipping the Doctor

You feel sore, not broken. You go home. A week later your wrist still will not bend.

Instead: Get checked the same day. Fractures, concussions and spinal injuries can hide for hours. A delay lets an insurer say something else caused the harm. It also matters legally: to pursue pain and suffering against a driver, New York generally requires a “serious injury” under Insurance Law § 5102(d), such as a fracture or significant limitation. Records prove it.

Then keep going. Follow-up visits matter as much as the first one. Gaps in treatment look like recovery to an adjuster, even when you simply could not get time off. Jot down pain, sleep and missed shifts each night. Here is a simple method for an injury diary.

Mistake 3: Missing the No-Fault Window

Many riders do not realize the car’s insurance covers them.

Instead: If a car hit you, file for no-fault benefits generally within 30 days. As a non-occupant under Insurance Law § 5103, you can generally get medical bills and part of lost wages paid. Paperwork questions? See the no-fault claims guide.

Mistake 4: Repairing or Tossing the Bike

The frame is bent. The battery looks scorched. You want it gone.

Instead: Store it untouched, helmet included. If brakes failed or the battery caught fire, the bike may support a product liability claim against the maker or seller. City rules back this up. Local Law 39 of 2023 demands UL 2849 for e-bikes sold, leased or rented in NYC, and UL 2271 for batteries. A battery that failed that standard is evidence. Keep a damaged battery away from living spaces; the FDNY battery safety page explains why.

Battery and helmet both belong in storage, not in the trash.

Mistake 5: Waiting to Ask for Video

Many of the Tudor-style detached homes here have doorbell cameras. Shops along the boulevards have them too. Buses carry them.

Instead: Knock on doors within a day or two. Ask owners to save the clip. Most systems record over old footage fast. A lawyer can send preservation letters, but only while the video still exists.

Same goes for witnesses. Get a name and number before they walk off. If you were riding for an app, screenshot the trip record too. Timestamps and routes can confirm where you were and how fast you were moving.

Mistake 6: Giving a Recorded Statement

The driver’s insurer calls. Friendly voice. “Just a few questions.”

Instead: Politely decline. Say your lawyer will be in touch. Statements given while in pain, on medication, or before you know your full injuries tend to get quoted back against you. The same caution applies to signing forms or medical releases the insurer mails you. Say little, sign nothing broad, and pass it all to counsel.

Mistake 7: Assuming Partial Fault Kills the Case

You were going a bit fast. No helmet. You assume you are out of luck.

Instead: Talk to someone first. Shared blame is handled by pure comparative fault, CPLR § 1411. Your share of blame reduces the award; it does not bar it. Our shared fault guide goes deeper.

Mistake 8: Losing Track of Deadlines

Three years sounds like plenty. It often is, for the lawsuit itself.

Instead: Mark every clock. Lawsuits generally must be filed within three years under CPLR § 214. City road-defect claims generally need notice within 90 days. Hit-and-run and uninsured-driver claims through your own policy or MVAIC carry strict, early deadlines. See our page on hit-and-run claims.

A Note for Delivery Riders and Pedestrians

Working when hit? Employees generally get workers’ compensation. Riders working through apps may be labeled independent contractors, and that label changes what benefits are on the table. A claim against a negligent driver may exist on top. Our work injury page covers that side.

Walking and struck by an e-bike? E-bikes are not motor vehicles, so no-fault generally does not apply to the bike. The claim is against the rider, and possibly the rider’s homeowners or renters insurance (policies vary) or a responsible business.
