One takeaway: the label on the device matters. Get it right early.
Why the label becomes a fight
Insurers read that table too. If they can call your e-bike something else, the coverage picture shifts. So can the fault picture. A throttle bike with a big battery might be described as a moped. A pedal-assist bike might be described as “too fast” for the street. Those arguments turn on facts: the maker’s specs, the class sticker, the top assisted speed, how you were riding. Keep the manual. Photograph any labels on the frame. Save the purchase receipt. A lawyer can then answer the classification question with documents instead of guesses. That early work often shapes everything that follows.
E-bikes up close
New York sets three classes under VTL § 102-c. Class 1 is pedal-assist only, up to 20 mph. Class 2 uses a throttle, up to 20 mph. Class 3 goes up to 25 mph and is allowed only in a city of 1 million or more, meaning New York City.
State law under VTL § 1242 bars anyone under 16 from operating one. Roads with a posted limit of 30 mph or lower are generally open to e-bikes. Sidewalks are off-limits unless local law allows. The city adds more through NYC DOT rules: 15 mph max, helmets on Class 3 and for work riders, no sidewalks, bike lanes and streets only.
Because VTL § 125 keeps e-bikes out of the motor vehicle definition, the e-bike carries no no-fault coverage of its own. That cuts both ways.

You were riding and a car hit you
Say a driver turned across you on Guy R. Brewer Boulevard. The car’s no-fault coverage generally pays your medical bills and part of lost wages under Insurance Law § 5103. The bike or the road failed
Brake failure or a battery fire can support a product liability claim against the maker or seller. NYC Local Law 39 of 2023 requires e-bikes sold, leased or rented in the city to meet UL 2849, and batteries UL 2271. A pothole on a city street may support a claim against the city; notice is generally due within 90 days under General Municipal Law § 50-e.
Fault and deadlines
New York uses pure comparative fault. Speeding or skipping a helmet may reduce recovery. It doesn’t bar it. Suit generally must be filed within three years.
