It is not charity and it is not a last resort you have to be ashamed of — it is a statutory safety net funded by the insurance industry precisely because uninsured vehicles exist on the road.
What MVAIC demands in return is speed and paperwork. A police report generally has to exist. Notice has to be filed promptly, on deadlines meaningfully shorter than the ordinary three-year limitations period. Eligibility rules apply — broadly, you must be a New York resident, and you must not have had your own insurance available to cover the loss. Every one of those requirements is satisfiable, and every one of them is routinely missed by people who waited to see whether their back would get better on its own.
Before reaching MVAIC, though, it is worth exhausting the alternatives, because they are often better. If anyone in your household carries auto insurance, uninsured motorist coverage on that policy may respond even though the car was not involved and you were only a passenger. If a second vehicle was involved in the collision and it was insured, that policy may cover your no-fault benefits regardless of which driver was at fault. A car that appears uninsured at the roadside is not always uninsured in fact — certificates lapse, get replaced, and get misreported.
Immigration status does not affect your claim

What to do in the first week
- Get a police report. Without one, an MVAIC claim becomes very difficult. Ask for the report number before anyone leaves.
- Photograph the plate and any base name or license sticker on the door or windshield. That is what identifies the owner and the insurer later.
- Keep the receipt, the app record, or the phone number you called. Any of these can trace back to the base.
- Be examined the same day, and tell the provider you were a passenger in a collision rather than only describing the pain.
- Do not accept cash at the roadside. A few hundred dollars in exchange for not reporting is not a settlement; it just removes your evidence.
- Give no recorded statement to any insurer before getting advice.
