UPS Truck Accident Lawyer in Rego Park

A UPS package car makes dozens of stops in a single shift in Rego Park: a pull-over on Queens Boulevard, a double-park on 64th Road, a quick reverse into a building driveway off 63rd Drive, then back into traffic. Each of those moves is a chance for something to go wrong for the driver next to it, the cyclist behind it or the pedestrian stepping off the curb. If you were hurt in one of those moments, a UPS truck accident lawyer in Rego Park can tell you who is responsible, how the company’s claims process works, and what your case requires under New York law.

Why a UPS Truck Accident Lawyer in Rego Park Looks at Delivery Patterns First

Most UPS crashes are not high-speed. They come out of the rhythm of package delivery: stop, park, unload, return, pull out, repeat. In a dense neighborhood like Rego Park, where Queens Boulevard has service roads, busy crosswalks and limited curb space, that rhythm creates predictable hazards:

  • Double parking. A truck stopped in the travel lane forces cars and bikes to swing around it, often into oncoming traffic or the path of a vehicle they could not see.
  • Backing. Delivery trucks have limited rear visibility. Reversing into a driveway, loading zone or alley without a clear view is a common cause of pedestrian injuries.
  • Pulling out from the curb. After a stop, a driver merging back onto Queens Boulevard or Woodhaven Boulevard may not see a car or cyclist approaching from behind.
  • Door and ramp hazards. Pedestrians and cyclists can be struck by an open door or by a driver stepping out with packages.
  • Time pressure. Delivery routes run on tight schedules, which can tempt any driver to roll stop signs, speed between stops or check a handheld device while moving.

Rego Park’s side streets add their own problems. Many blocks between Queens Boulevard and the Long Island Expressway are lined with apartment buildings, parked cars and narrow lanes. A truck that stops in the middle of one of those streets can block sightlines at an intersection for everyone else.

Who Is Liable When a UPS Driver Causes a Crash

This is where UPS cases often differ from other delivery claims. UPS package-car drivers are generally company employees. Under the doctrine of respondeat superior, an employer is generally responsible for an employee’s negligence while the employee is acting within the scope of the job, so a delivery driver making stops on an assigned route is usually acting for the company.

New York adds a second layer. Under Vehicle and Traffic Law §388, the owner of a vehicle is generally liable for injuries caused by the negligence of anyone using it with the owner’s permission. When the company owns the truck, that provides another route to the responsible party. In practice, that means the claim is usually against the company and its coverage, not just the individual driver.

How that compares with other delivery models

Not every delivery company is set up the same way, and that affects who you sue:

Delivery modelWho typically employs the driverWhy it matters
UPS package carsThe company itself (drivers are generally employees)Employer liability is usually straightforward to establish
FedEx Ground / Home DeliveryIndependent contractor businesses (often called service providers) that hire their own driversThe contractor and its insurer may be the primary defendants; the parent company’s role is fact-specific
Amazon delivery vansOften Delivery Service Partners, independent companies that employ the driversThe partner company is typically the employer; vehicle ownership and leasing arrangements need to be checked

These are general descriptions. The specific employer, vehicle owner and insurer in your case have to be confirmed from the police report, the registration and the company’s own records.

Dealing With the Company’s Claims Process

After a crash with a large corporate fleet, the call you get is usually from someone handling claims on the company’s behalf, whether an in-house claims department, an insurer or an outside claims administrator. Whoever it is, their job is to resolve the claim for as little as possible. A few practical points:

  • You are not required to give a recorded statement to the other side’s claims representative. Talk to a lawyer first.
  • Early settlement offers often arrive before the full extent of an injury is known, and signing a release usually ends the claim for good.
  • Your own no-fault insurer pays first for medical bills and lost wages up to the policy limits. The no-fault application is generally due within 30 days.
  • To recover for pain and suffering, you must meet New York’s serious-injury threshold under Insurance Law §5102(d).

For motor-vehicle cases, the 2026 budget removed the “90/180-day” category, leaving eight serious-injury categories: death; dismemberment; significant disfigurement; fracture; loss of a fetus; permanent loss of use of a body organ, member, function or system; permanent consequential limitation of use of a body organ or member; and significant limitation of use of a body function or system. Under Insurance Law §5104, fault is decided before serious injury.

Telematics, Scanners and Cameras: The Evidence in a Delivery Truck Case

Delivery fleets generate a remarkable amount of data. UPS has publicly described its extensive use of vehicle telematics, and large fleets commonly record speed, braking, reverse gear, engine status and GPS location. Drivers also carry handheld devices that time-stamp each delivery, which can help show where the truck was stopped and for how long. Add dash cameras and the security cameras on Queens Boulevard storefronts and lobby entrances, and a delivery crash can often be reconstructed second by second.

The challenge is preservation. Video from building and store systems is often overwritten within days, and a company is not going to volunteer its data. Our first step is a written preservation demand identifying the truck, the route and the records we expect the company to keep. Meanwhile, you can help:

  1. Get medical care right away and follow up.
  2. Photograph the truck, including its vehicle number on the side or rear, and the street layout around it.
  3. Note whether the truck was double-parked, backing up or pulling out, and where its hazard lights were.
  4. Get the names and numbers of witnesses, and the NYPD report number.
  5. Write down which buildings or stores face the crash site, so their cameras can be requested.

Shared Fault and the New Damages Rules

Delivery companies often argue that the other driver should have waited behind a double-parked truck, or that the pedestrian walked behind a reversing vehicle. In motor-vehicle injury actions under Insurance Law Article 51 commenced on or after May 26, 2026, new CPLR 1411(b) means a claimant who is more at fault than the defendants combined recovers nothing, and a claimant who is 50% or less at fault has the award reduced proportionally. The filing date controls. Under new Insurance Law §5104(d), an at-fault claimant who was driving uninsured (outside a narrow exception for lapses of under 30 days), was convicted of impaired driving, or was convicted of a felony committed while driving is limited to $100,000 in non-economic damages; economic damages, other people’s claims and wrongful death claims are not capped by that rule.

Compensation in a successful claim can include medical expenses beyond no-fault, lost wages and earning capacity, pain and suffering, and future care. We do not predict values before reviewing the records, and every case depends on its facts.

If You Are a UPS Driver Who Was Hurt on the Job

Delivery drivers get hurt too: rear-ended while stopped, struck by a car while unloading, or injured lifting and carrying heavy packages. If you are a UPS employee injured at work, your path usually runs through two systems.

Workers’ compensation

Workers’ compensation generally pays medical care and a portion of lost wages regardless of fault. You should give your employer written notice within 30 days and file a claim with the New York State Workers’ Compensation Board within two years. Under Workers’ Compensation Law §11, you generally cannot sue your own employer for a workplace injury except in limited “grave injury” situations.

Third-party claims

If someone other than your employer caused the injury, such as a careless driver who rear-ended your truck on Woodhaven Boulevard, you may also have a lawsuit against that person. The workers’ compensation carrier typically has a lien on part of the recovery, which has to be negotiated. Our work-related injury lawyers handle both pieces together.

Deadlines That Apply to Delivery Truck Claims

StepDeadline (general rule)
No-fault application30 days from the accident
Written notice to employer (injured UPS workers)30 days
Workers’ compensation claim2 years
Notice of Claim, if a city vehicle or city road condition was involved90 days (GML §50-e)
Lawsuit against the City1 year and 90 days (GML §50-i)
Personal injury lawsuit against the company and driver3 years (CPLR 214)

Rego Park Delivery Routes We Know

Rego Park sees constant package traffic: apartment towers that receive hundreds of deliveries a day, the stores around Rego Center by the Long Island Expressway, and the shops along Queens Boulevard and 63rd Drive near the M and R station at 63 Drive–Rego Park. Junction Boulevard and Woodhaven Boulevard bracket the neighborhood and carry trucks in and out. Our Rego Park accident lawyers handle claims from every one of those blocks. If a larger commercial vehicle was involved, see our guide to truck accidents in Rego Park, or our page on semi and tractor-trailer crashes.

How Our Firm Handles Your Case

We investigate before we negotiate. That means preservation letters, requests for the police report and company records, canvassing for video along the route, and identifying the employer, owner and every policy that may apply. We coordinate with your doctors, handle the no-fault paperwork, and deal with the company’s claims representatives so you do not have to. Consultations are free, and we work on contingency, so there is no fee unless we recover.

UPS Truck Accident FAQs

Can I sue UPS if its driver hit me in Rego Park?

Often, yes. UPS package-car drivers are generally employees, and an employer is generally responsible for an employee’s negligence on the job. New York Vehicle and Traffic Law §388 also generally makes a vehicle owner liable for a permissive driver’s negligence. The facts of each crash still have to be proven.

Is a crash with a FedEx or Amazon truck handled the same way?

Not always. FedEx Ground and many Amazon deliveries use independent contractor companies that employ their own drivers, so the primary defendant may be that contractor and its insurer. The details depend on the specific vehicle and company.

Is a double-parked delivery truck automatically at fault?

No. A double-parked truck can contribute to a crash, but fault depends on everyone’s conduct. Under the 2026 rule for motor-vehicle cases, your recovery is reduced by your share of fault, and barred if you are more at fault than the defendants combined.

Should I talk to the claims representative who called me?

You can decline to give a recorded statement. It is wise to speak with a UPS truck accident lawyer in Rego Park before discussing fault or signing anything.

I am a UPS driver and was rear-ended on my route. What are my options?

Workers’ compensation generally covers your medical care and part of your lost wages. You may also have a separate claim against the driver who hit you, subject to the comp carrier’s lien.

Is your firm connected with UPS?

No. Yakov Mushiyev & Associates is an independent law firm. UPS is a trademark of its owner, and we are not affiliated with or endorsed by UPS.
