Semi Truck & Tractor Trailer Accident Lawyer in Rego Park

An 18-wheeler coming off the Long Island Expressway at Woodhaven Boulevard can weigh up to 80,000 pounds loaded, or roughly twenty times the weight of the sedan in the next lane. When a vehicle that size makes a mistake in Rego Park, the result is rarely a fender-bender. If you or someone in your family was hit by a big rig, you need a semi truck accident lawyer in Rego Park who knows that these cases are built on federal safety rules, electronic records and corporate insurance, not just a police report. This page is also written for anyone searching for a tractor trailer accident lawyer in Rego Park, because a semi and a tractor trailer are the same machine: a power unit (the tractor) pulling one or more trailers.

Yakov Mushiyev & Associates, P.C. represents injured people throughout Queens. Below we explain what separates a tractor-trailer case from an ordinary car crash, who can be held responsible, where the evidence lives, and how New York’s 2026 changes affect a claim. If you would rather talk now, call 718.775.3110 for a free consultation. There is no fee unless we recover for you.

Why a Semi Truck Accident Lawyer in Rego Park Handles These Cases Differently

Our firm already publishes a broader guide for truck accident claims in Rego Park that covers box trucks, dump trucks, garbage trucks and the full range of commercial vehicles. This page is narrower. As a semi truck accident lawyer in Rego Park, we wrote it for heavy combination vehicles: the tractor-trailers that move freight along the Long Island Expressway into Queens.

Three things make these crashes different from everyday collisions:

  • They are governed by federal law. A truck carrying freight in interstate commerce must comply with the Federal Motor Carrier Safety Regulations (FMCSRs) in Title 49 of the Code of Federal Regulations. A violation of those rules is often the strongest piece of liability evidence in the case.
  • There are usually several companies involved. The driver, carrier, trailer owner, broker, shipper and repair shop may each have a different insurer.
  • The physics are unforgiving. A fully loaded tractor-trailer needs far more distance to stop than a passenger car, and its size creates blind spots, wide turning paths and underride hazards that simply do not exist with smaller vehicles. Injuries tend to be severe.

Federal Trucking Rules That Often Decide Fault

A tractor-trailer accident lawyer in Rego Park should be reading the trucking company’s compliance file before the insurance adjuster has finished the first phone call. These are the federal rules we look at most often:

Hours of service (49 CFR Part 395)

Fatigue is one of the most persistent problems in trucking. Under the FMCSA hours-of-service rules, a property-carrying driver may drive no more than 11 hours after 10 consecutive hours off duty, may not drive beyond the 14th hour after coming on duty, must take a 30-minute break after 8 cumulative hours of driving, and is subject to a 60-hour/7-day or 70-hour/8-day limit. A driver pushing to make a Queens delivery window after a long day may already be at the edge of those limits.

Electronic logging devices (ELDs)

Most interstate truck drivers who must keep records of duty status are required to record them on an electronic logging device rather than a paper logbook. The ELD ties into the truck’s engine and records driving time automatically, which makes it much harder to falsify a log. Federal rules require carriers to keep records of duty status and supporting documents for six months, which is one reason we send preservation demands right away.

Driver qualification (49 CFR Part 391)

Motor carriers must keep a driver qualification file for each driver, including the employment application, a motor vehicle record check, road test or equivalent, and a current medical examiner’s certificate. When a carrier put an unqualified or medically uncertified driver behind the wheel, that can support a negligent hiring or negligent supervision claim against the company itself.

Inspection, repair and maintenance (49 CFR Part 396)

Carriers must systematically inspect, repair and maintain their vehicles. Drivers must complete post-trip inspection reports on defects, and every commercial motor vehicle needs a periodic (at least annual) inspection. Federal rules for parts and accessories are in 49 CFR Part 393, which includes rear-impact guard requirements for most trailers.

Rego Park Truck Routes: The LIE, Queens Boulevard and Woodhaven Boulevard

Rego Park sits at a crossroads. The Long Island Expressway cuts across the north side of the neighborhood with an exit at Woodhaven Boulevard, Woodhaven Boulevard runs north–south past the Rego Center and Queens Center area, and Queens Boulevard carries traffic from Elmhurst toward Forest Hills with its center lanes, service roads and long pedestrian crossings. Big rigs use all three to reach the supermarkets, department stores and retail loading docks along Junction Boulevard, 63rd Drive and the malls near the expressway.

New York City restricts where trucks may travel. Under Section 4-13 of the city’s traffic rules, a truck (defined by NYC DOT as a vehicle with two axles and six tires, or three or more axles) must stay on the designated NYC truck route network. Through trucks with no stop in the borough must use through truck routes; trucks making local deliveries may use local truck routes, and may leave the network only at the intersection nearest their destination and only by the most direct path. NYC DOT has also announced changes to the truck route network taking effect October 4, 2026. When a semi turns onto a residential block in Rego Park because a GPS app suggested a shortcut, the route violation itself can become evidence of negligence.

Crash patterns we see with big rigs

  • Wide right turns. A tractor-trailer turning right from Queens Boulevard or Woodhaven Boulevard often swings left first to clear the corner. Drivers in the right lane or cyclists along the curb can be crushed in the gap that opens up.
  • Underride collisions. When a car slides beneath the rear or side of a trailer, the trailer bed can strike the windshield and the occupants’ heads. Rear-impact guards are federally required on most trailers; side guards generally are not, which is why side underride crashes are so lethal.
  • Jackknifes. Hard braking on a wet LIE ramp, an unevenly loaded trailer or poorly adjusted brakes can cause the trailer to swing out at an angle to the tractor, sweeping across several lanes.
  • Blind-spot lane changes. Large trucks have significant blind spots directly in front, directly behind and along both sides, especially the right side. Merging traffic near the Woodhaven Boulevard exit is a common setting.
  • Pedestrian strikes. A driver sitting high in a cab may not see someone in the crosswalk directly in front of the bumper.

Who Is Responsible? Finding Every Defendant in a Tractor-Trailer Case

An experienced tractor trailer accident lawyer in Rego Park does not stop at the driver. Depending on the facts, these parties may share responsibility:

PartyWhy they may be liable
Truck driverSpeeding, distraction, fatigue, impairment, unsafe turns or lane changes, route violations
Motor carrierResponsible for its employee drivers’ conduct on the job, plus its own negligent hiring, training, supervision, dispatching or maintenance
Vehicle ownerUnder New York Vehicle and Traffic Law §388, the owner of a vehicle is generally liable for negligence of a person using it with permission
Freight brokerMay be pursued in some cases, such as negligent selection of an unsafe carrier; this area of law is unsettled and fact-specific
Shipper or loaderOverweight, unbalanced or unsecured cargo can cause rollovers, jackknifes and spilled loads
Maintenance or repair shopFaulty brake work, tire service or inspections
ManufacturerDefective brakes, tires, steering components or underride guards
City or StateDangerous road design or signal defects — strict Notice of Claim deadlines apply

Insurance: Federal Minimums and Who Pays

Federal regulations at 49 CFR Part 387 set minimum financial responsibility for interstate for-hire carriers. For general freight in vehicles of 10,001 pounds or more, the minimum is $750,000; certain oil shipments require $1,000,000 and many hazardous materials loads require $5,000,000. These are floors, not ceilings — many carriers carry more, often with excess or umbrella layers on top.

Your own no-fault coverage (New York Insurance Law Article 51) is still the first source for medical bills and lost wages up to the policy limits, and the no-fault application generally must be filed within 30 days. To step outside no-fault and sue the truck company for pain and suffering, you must meet the “serious injury” threshold in Insurance Law §5102(d). For motor-vehicle cases, the 2026 budget removed the old “90/180-day” category, leaving eight categories, including fracture, significant disfigurement, permanent consequential limitation of use of a body organ or member, and significant limitation of use of a body function or system. Under Insurance Law §5104, fault is now decided before serious injury.

The Black Box: ECM Data, ELD Records and Other Evidence That Disappears

Most modern tractors have an engine control module (ECM) — often called the black box — that can capture speed, throttle position, brake application, cruise control status and sometimes hard-braking events in the seconds around a crash. Together with ELD, GPS, dash-cam and dispatch records, it can show what the driver was doing. It can also be overwritten or lost if the truck goes back into service.

That is why one of our first moves in a semi truck case is a written preservation (spoliation) demand to the carrier and its insurer, identifying the truck, trailer, driver and the categories of evidence we expect them to keep. New York courts can sanction a party that destroys relevant evidence after it was on notice of a claim. In the first days after a crash, you can help by doing the following:

  1. Get medical care right away, and tell the providers every symptom — neck, back, head, numbness, memory problems.
  2. Write down or photograph the truck’s company name, USDOT number (usually on the cab door), trailer number and license plates.
  3. Photograph the scene, the vehicles, skid marks and any nearby storefronts on Queens Boulevard or Woodhaven Boulevard that may have security cameras.
  4. File your no-fault application within 30 days.
  5. Do not give a recorded statement to the trucking company’s insurer before talking to a lawyer.

Comparative Fault After the 2026 Changes

Trucking insurers routinely argue that the car driver cut in front of the truck or lingered in a blind spot. In motor-vehicle injury actions under Insurance Law Article 51 commenced on or after May 26, 2026, new CPLR 1411(b) applies a modified comparative-fault rule: a claimant who is more at fault than the defendants combined recovers nothing, and a claimant who is 50% or less at fault has the award reduced proportionally. Because the filing date controls, timing can matter. A separate rule, Insurance Law §5104(d), caps non-economic damages at $100,000 for an at-fault claimant who was driving uninsured (with a narrow exception for a lapse of less than 30 days), was convicted of impaired driving, or was convicted of a felony committed while driving. That cap does not limit economic damages, other people’s claims or wrongful death claims.

Deadlines for a Rego Park Truck Accident Claim

DeadlineWhat it covers
30 daysNo-fault application to the insurer paying your benefits (generally)
90 daysNotice of Claim against New York City or another public entity, if a city vehicle or road condition was involved (GML §50-e)
1 year 90 daysLawsuit against the City or other public entity (GML §50-i)
2 yearsWrongful death action (EPTL §5-4.1), measured from the date of death
3 yearsPersonal injury lawsuit against the driver, carrier and other private defendants (CPLR 214)
6 monthsTypical federal retention period for drivers’ records of duty status — a practical reason to act fast

Damages in a Semi Truck Injury Case

Depending on the injuries and the proof, compensation can include past and future medical expenses beyond what no-fault pays, lost earnings and lost earning capacity, pain and suffering, loss of enjoyment of life, and the cost of home modifications or long-term care. When a crash is fatal, the family may bring a wrongful death claim.

How Our Firm Handles a Tractor-Trailer Case

Attorney Yakov Mushiyev and our team approach heavy-truck cases as investigations first. That means preservation letters within days, requests for the driver qualification file, hours-of-service records, maintenance logs and ECM downloads, a review of the carrier’s federal safety history, and a hard look at the route the truck took through Queens. We also identify every policy that may apply. For a broader overview of how we handle commercial-vehicle claims across New York, see our truck accident lawyer practice page.

Semi Truck and Tractor Trailer Accident FAQs

Is a semi truck the same as a tractor-trailer?

Yes. Semi truck, 18-wheeler, big rig and tractor-trailer all describe a tractor (the power unit) pulling one or more trailers. The legal issues — federal safety rules, multiple defendants and higher insurance limits — are the same.

Do federal trucking rules apply to a crash on a Queens street?

Generally yes, if the truck was operating in interstate commerce. The Federal Motor Carrier Safety Regulations govern the carrier and driver wherever the truck is, including on Queens Boulevard or Woodhaven Boulevard.

How much insurance does a tractor-trailer company have to carry?

For interstate for-hire carriers hauling general freight in vehicles of 10,001 pounds or more, the federal minimum is $750,000. Higher minimums apply to certain oil and hazardous materials loads, and many carriers carry more than the minimum.

Can I sue the trucking company and not just the driver?

Often, yes. A carrier is generally responsible for an employee driver acting within the scope of the job, and New York Vehicle and Traffic Law §388 generally makes a vehicle owner liable for a permissive driver’s negligence. The carrier can also be liable for its own negligent hiring, training or maintenance.

Are trucks allowed on residential streets in Rego Park?

NYC rules require trucks to stay on designated truck routes unless making a local delivery, and then to use the most direct path to and from the nearest route. A truck cutting through side streets without a delivery there may be violating those rules.

How long do I have to file a semi truck accident claim in New York?

Generally three years from the crash for a personal injury lawsuit against private parties (CPLR 214). Claims involving a city vehicle or road condition require a Notice of Claim within 90 days. Your no-fault application is generally due within 30 days.

Can you visit me in the hospital?

Yes. We offer free consultations and can meet you at home or at the hospital anywhere in Queens.
