Tractor Trailer Accident Lawyer in Forest Hills

Forest Hills was laid out for trains and pedestrians, not 70-foot rigs. Yet every week tractor-trailers squeeze down Queens Boulevard, swing onto Metropolitan Avenue and idle near Austin Street storefronts. When one of them hits a car, a cyclist or someone in a crosswalk, the injured person ends up facing a trucking company, its insurer and often a defense lawyer within days. A tractor trailer accident lawyer in Forest Hills evens that out by getting to the evidence first and holding every responsible company to account.

We are Yakov Mushiyev & Associates, P.C., a Queens personal injury firm. This guide is written from the street level: where big rigs actually travel in Forest Hills, why they crash here, and the practical steps that protect a claim. For a free consultation, call 718.775.3110.

Where Tractor-Trailers Go in Forest Hills — and Where They Are Not Allowed

Two of the roads that border Forest Hills are off-limits to trucks entirely. The Grand Central Parkway and the Jackie Robinson Parkway are parkways, and New York City bans trucks and commercial vehicles from most parkways. A tractor-trailer that a driver routes onto one of them, often by following a consumer GPS app rather than a truck-specific navigation system, is breaking the rules before anything else happens.

Everywhere else, trucks must follow the city’s truck route network under Section 4-13 of the NYC traffic rules. A truck making a local delivery may leave a designated route only at the intersection nearest its destination and must take the most direct path there and back. NYC DOT has also announced truck route network changes effective October 4, 2026. In Forest Hills, that means big rigs heading for Austin Street shops or the businesses near Metropolitan Avenue should not be cutting through the quiet blocks of Forest Hills Gardens or the side streets off Yellowstone Boulevard. When they do, the route itself becomes evidence.

The corridors that see the most heavy-truck traffic

  • Queens Boulevard. Multiple lanes, service roads, frequent pedestrian crossings near 71st Avenue/Continental Avenue, and trucks merging between the main road and the service road.
  • Woodhaven Boulevard. The western edge of the neighborhood, carrying traffic between the Long Island Expressway and southern Queens.
  • Metropolitan Avenue. A long east–west route with commercial frontage and delivery traffic toward Middle Village and Kew Gardens.
  • Union Turnpike. Along the north side near Forest Park and Kew Gardens, with heavy cross traffic and turning conflicts.

Delivery Day on Austin Street: How These Crashes Happen

Many tractor-trailer crashes in Forest Hills happen at low speed. A trailer backs toward a loading area while a pedestrian walks behind it. A driver double-parks on a narrow commercial block and a cyclist swerves into traffic to get around. A rig turning right from Queens Boulevard swings wide and pins a car against the curb. These are not highway pileups, but the weight of a loaded trailer turns a slow-speed impact into a serious injury.

The no-zones

Every large truck has blind spots large enough to hide a car — sometimes called no-zones. They sit directly in front of the cab, directly behind the trailer, along the left side behind the driver’s door, and along most of the right side. The right-side zone is the most dangerous in a dense neighborhood: a driver turning right onto Austin Street or 71st Avenue may never see the pedestrian or bicycle rider beside the trailer. Trucking companies train drivers on these zones, and a driver who turns or backs without checking mirrors, using a spotter where needed, or sounding a warning may be negligent.

Other recurring causes

  • Drivers who are fatigued or over their federal hours-of-service limits after long hauls from distribution centers
  • Phone use and dispatch messages while driving
  • Brakes, tires or lights that were not properly inspected and maintained
  • Overloaded or poorly secured cargo that shifts in a turn
  • Trailer underride, when a car slides under the rear or side of the trailer

The Spoliation Letter: What a Tractor Trailer Accident Lawyer in Forest Hills Does in the First Ten Days

The single most time-sensitive task in a big-rig case is preserving evidence that the trucking company controls. A spoliation (preservation) letter puts the carrier and its insurer on formal notice that litigation is likely and that they must keep specific evidence. Once a party is on notice, New York courts can impose sanctions if relevant evidence is destroyed. Here is what our letters typically demand:

  1. Engine control module (ECM) data — speed, braking and throttle in the moments before impact.
  2. Electronic logging device records and supporting documents showing the driver’s hours. Federal rules require carriers to keep these for six months, so waiting can mean losing them.
  3. Dash-cam and telematics footage, including any driver-facing camera.
  4. The driver qualification file: application, driving record checks, medical certificate and training records.
  5. Inspection, maintenance and repair records for the tractor and trailer.
  6. Bills of lading and dispatch records showing the load, its weight, the shipper and the delivery address in Forest Hills.
  7. The truck and trailer themselves, so they are not repaired or sold before an inspection.

We also canvass the block. Businesses along Austin Street, Queens Boulevard and Metropolitan Avenue often have cameras, and a doorman building’s lobby camera may have caught the turn. That footage tends to be overwritten quickly, so it is worth requesting right away.

Who Answers for a Tractor-Trailer Crash

The driver is rarely the only defendant. A motor carrier is generally responsible for the negligence of its employee drivers while they are working, and can also be liable for its own negligent hiring, training, supervision or maintenance. Under New York Vehicle and Traffic Law §388, the owner of a vehicle is generally liable for injuries caused by someone driving it with permission, which matters when the tractor and trailer belong to a leasing company or different business. Depending on the facts, the shipper that loaded the trailer, a repair shop that worked on the brakes, or a manufacturer of a defective part may also share responsibility. If a city vehicle or a road defect played a role, a Notice of Claim must be filed within 90 days.

Insurance coverage

Interstate for-hire carriers must carry at least $750,000 in liability coverage for general freight in vehicles of 10,001 pounds or more under 49 CFR Part 387, with higher minimums for certain oil and hazardous-materials loads. Many carriers carry more through excess policies. That is usually far more coverage than an ordinary driver has, and the insurer defends it accordingly.

On the New York side, your no-fault benefits pay first for medical bills and lost wages up to the policy limits; the application is generally due within 30 days. To sue for pain and suffering, you must meet the serious-injury threshold in Insurance Law §5102(d). The 2026 budget removed the “90/180-day” category for motor-vehicle cases, leaving eight categories: death; dismemberment; significant disfigurement; fracture; loss of a fetus; permanent loss of use of a body organ, member, function or system; permanent consequential limitation of use of a body organ or member; and significant limitation of use of a body function or system. Under Insurance Law §5104, fault is now determined before serious injury.

Shared fault under the new rule

For motor-vehicle injury actions commenced on or after May 26, 2026, CPLR 1411(b) bars recovery for a claimant who is more at fault than the defendants combined, and reduces the award proportionally for a claimant who is 50% or less at fault. Trucking defense teams will argue that you lingered in a no-zone or cut in front of the rig. Separately, Insurance Law §5104(d) caps non-economic damages at $100,000 for an at-fault claimant who was driving uninsured (with a narrow exception for a lapse under 30 days), was convicted of impaired driving, or was convicted of a felony committed while driving. It does not limit economic damages, other people’s claims or wrongful death claims.

What Compensation Can Cover

A tractor-trailer crash can mean surgery, months of physical therapy and time away from work. A claim can seek medical costs not paid by no-fault, past and future lost income, reduced earning capacity, pain and suffering, and the cost of future care. Families who lose someone may bring a wrongful death claim. We never quote a value before we have the records, and no outcome is guaranteed.

How We Work Your Case

We start with preservation and investigation, not paperwork. We send the spoliation letter, request the police report and crash data, look up the carrier’s federal registration and safety history, and track down witnesses and video along the route the truck took. We work with your treating doctors so your injuries are documented accurately, and we deal with the insurers so you can focus on recovery. Our Forest Hills truck accident lawyer page covers smaller commercial trucks as well; this page is focused on the heaviest rigs, as is our guide for a semi truck crash in neighboring Rego Park. If you were walking when you were hit, our pedestrian accident team handles those claims too.

Frequently Asked Questions

Are tractor-trailers allowed on the Grand Central Parkway or Jackie Robinson Parkway?

No. Trucks and commercial vehicles are banned from most New York City parkways, including these two. A rig on either parkway is violating city rules, which can be important evidence in a crash claim.

Why do I need a tractor trailer accident lawyer in Forest Hills instead of handling it with the insurer?

Trucking insurers protect large policies and act quickly. A lawyer can send a spoliation letter to preserve ECM, ELD and camera evidence, identify every liable company, and make sure the serious-injury and fault rules are applied correctly.

What is a spoliation letter?

It is a written demand that the trucking company and its insurer preserve specific evidence, such as black box data, logbooks, maintenance records and the truck itself. Once on notice, a party that destroys relevant evidence can face court sanctions.

What are a truck’s no-zones?

They are the blind spots directly in front of the cab, directly behind the trailer, and along both sides, especially the right. Turning and backing crashes in Forest Hills often happen in these zones.

Can a truck make deliveries on Austin Street side streets?

A truck making a local delivery may leave the designated truck route, but only at the intersection nearest its destination and by the most direct path. Cutting through residential blocks without a delivery there may violate NYC traffic rules.
