The Law Is on Your Side More Than You Think
Under New York’s Vehicle and Traffic Law a cyclist holds the rights and duties of any other vehicle operator. You are entitled to be on the road, not tolerated on it.
On top of that, VTL § 1146 places a specific duty on every driver to exercise due care to avoid colliding with a bicyclist. “I didn’t see the bike” is not a defense to that — it is a description of the breach.
You Probably Have No-Fault Cover
Very few cyclists know this. If you were on a conventional bicycle and were struck by a motor vehicle, no-fault benefits are generally available through the insurer of the vehicle that hit you — medical treatment and part of your lost earnings, regardless of fault.
No car of your own required, no policy required. The application is due within 30 days, and because nobody prompts a cyclist, that is exactly where it gets lost.
E-bikes are a different and less settled question. Long Beach has a great many of them, and whether the same treatment applies turns on the class of device and how it is characterized. Do not accept a roadside opinion either way — get the classification established early, because everything downstream depends on it.

How Riders Get Hit Here
Dooring is the signature Long Beach collision. Park Avenue and the side streets are lined with curbside parking, and in summer people are getting out of cars constantly, often on the traffic side, often carrying beach gear. A door opened into a rider is the fault of whoever opened it — full stop.
Right hooks and driveway pull-outs account for most of the rest, particularly where a driver is focused on finding parking rather than on the lane beside them.
Surface conditions matter more on a barrier island than inland. Blown sand on the carriageway acts like gravel under a narrow tire, and it accumulates on the streets closest to the beach. Sunken drain grates, broken pavement and standing water do the rest. Where a defect on City property caused the fall, the claim runs against the City of Long Beach on a 90-day Notice of Claim under General Municipal Law § 50-e, with suit inside one year and 90 days, and generally a prior written notice requirement.
Helmets, Lanes and the Blame Game
New York requires helmets for riders under 14. For adults it is not mandatory, and not wearing one does not bar your claim. It may be argued against head-injury damages specifically, and that is the extent of it.
The same applies to riding outside a marked lane, riding without lights, or riding on the boardwalk outside permitted hours. Under pure comparative negligence (CPLR 1411), each argument shaves a percentage off. None of them hands the driver a defense.
Against a private driver the deadline is three years under CPLR 214. Where no-fault applies, pain and suffering additionally requires clearing the threshold in Insurance Law § 5102(d) — which cycling injuries frequently do, since collarbone, wrist and rib fractures qualify outright.
What To Do
- Call 911 and insist on a report. Cyclists are routinely told one is not needed.
- Be examined properly, even if you got up and walked the bike away.
- Do not repair, clean or discard the bike, helmet or clothing. Damage patterns establish impact direction and speed better than memory does.
- Photograph the scene — the open door if you were doored, the vehicle position, sand or debris on the surface, sightlines.
- Export your ride data if you use an app or head unit. Objective speed and route logs are hard to argue with.
- Note nearby cameras before footage cycles out.
- Give no recorded statement to the driver’s insurer first.
