You Are Entitled to Benefits You Have Probably Never Heard Of
New York no-fault is not only for people inside vehicles. A pedestrian struck by a motor vehicle is generally entitled to no-fault benefits — medical treatment and part of lost earnings — regardless of fault, usually through the insurer of the vehicle that hit them.
You need no car and no policy of your own. You need to file within 30 days.
Pedestrians lose this more than anyone, because nobody is prompting them. A driver has an insurer walking them through the process. A person on foot has no one, and often does not learn the form existed until the window has closed.

The Driver Owes You Care Wherever You Were
The insurer’s opening line will be that you crossed mid-block, stepped out between parked cars, or were walking back from the beach not paying attention.
New York’s Vehicle and Traffic Law requires drivers to yield in marked crosswalks and at unmarked crosswalks at intersections. Separately, VTL § 1146 imposes a duty on every driver to exercise due care to avoid colliding with a pedestrian — and that duty applies whether or not you were in a crosswalk.
Mid-block crossing is extremely common in Long Beach, because people cross where the boardwalk access is rather than where the junction is. It does not hand the driver a defense. Under pure comparative negligence (CPLR 1411), shared fault reduces recovery proportionally and nothing more.

Park Avenue carries the through traffic and the commercial frontage, so most crossings happen where the turning conflicts are. The streets running south toward the boardwalk are crossed constantly in season, often by people carrying chairs and coolers with limited sightlines.
The station area concentrates people arriving on foot with no local knowledge. Reversing and parking maneuvers cause a distinct category of low-speed but serious injuries, especially to children and older pedestrians. And on West Beech Street the late-night mix of pedestrians and vehicles produces its own pattern in summer.
If the Street Itself Was Part of It
A failed street light, a missing or faded crossing, an obscured sign or a broken signal can make the City of Long Beach a defendant. Long Beach is an incorporated city, so the claim runs against the City itself — not the Town of Hempstead, and not Nassau County.
That means a Notice of Claim within 90 days under General Municipal Law § 50-e, suit within one year and 90 days, and generally a requirement of prior written notice of the specific defect. Against a private driver the deadline is the ordinary three years under CPLR 214.
Why These Cases Clear the Threshold
Pain and suffering requires meeting the “serious injury” threshold in Insurance Law § 5102(d). In vehicle-to-vehicle claims that is fought hard. In pedestrian claims it usually is not — an unprotected body against a vehicle produces fractures, and a fracture qualifies outright.
Head injury deserves particular attention. It is regularly missed in a brief emergency assessment and shows itself over the following weeks through memory, concentration, mood and sleep. Report every symptom, including the ones that feel too vague to be worth mentioning.
What To Do
- Call 911. Long Beach PD will generate the report — note the number.
- Get the driver’s license, insurance and plate, or have a bystander do it. Out-of-town drivers become hard to trace.
- Go to the hospital and be examined properly.
- Photograph where you were, where the vehicle stopped, and the damage to it. The point of impact on the bodywork often contradicts the driver’s version.
- Note every nearby camera — shops, bars, homes, doorbells. Most footage is gone within days.
- Get witness numbers immediately. In summer they are frequently visitors who leave that evening.
- Give no recorded statement before speaking with a lawyer.
