Three States of the App, Three Levels of Cover
Outside New York City, rideshare operates under the state’s Transportation Network Company framework rather than TLC rules. Coverage steps up in stages:
- App off. An ordinary private driver on an ordinary personal policy — frequently minimum limits.
- App on, no ride accepted. Contingent coverage applies, but modestly — in the region of $75,000 per person and $150,000 per accident for bodily injury.
- Ride accepted, or passenger aboard. The full commercial policy — $1,250,000 combined for death and bodily injury.
Between the second and third state there is roughly a twelvefold jump in available coverage, and the boundary is a single tap on a phone. If a driver accepted a request four seconds before impact, that is a materially different case from one where they had not.
Only the rideshare company holds the data that settles it. They do not volunteer it, and it is not something you can obtain by asking politely after the fact. Getting a preservation demand in front of them early is the practical heart of these cases.
The Independent Contractor Argument
Rideshare companies classify drivers as independent contractors rather than employees. That is not incidental — it is the structure that lets them argue they are not vicariously responsible for a driver’s conduct, and instead point at the insurance policy as the beginning and end of their involvement.
It is one reason these claims are not simply larger car accident claims. Knowing which entity to pursue, and on what theory, changes what is recoverable.
Who Can Claim
Passengers are in the strongest position of anyone involved — a back-seat rider is essentially never comparatively at fault, so you can pursue whichever driver was responsible without the usual argument about your own share.
Other motorists, pedestrians and cyclists struck by a rideshare vehicle have claims against whichever policy applied at that moment. Rideshare drivers themselves do too, though their contractor status complicates matters.
New York applies pure comparative negligence under CPLR 1411, so even a claimant carrying some blame recovers a proportionally reduced amount.
The Clocks
No-fault covers your initial treatment and part of your lost earnings regardless of fault, and the application is due within 30 days. As a rideshare passenger the correct insurer is genuinely not obvious, and filing against the wrong one wastes time you do not have.
Pain and suffering additionally requires meeting the “serious injury” threshold under Insurance Law § 5102(d). The lawsuit deadline is generally three years under CPLR 214. If the at-fault vehicle fled and was never identified, MVAIC may provide a route, on shorter notice terms.
What To Do — Starting With Your Phone
- Screenshot the trip immediately. Driver name, vehicle, plate, trip ID, timestamps, map. Trips can vanish from ride history, and this is your only independent record of which coverage period applied.
- Report the crash inside the app so it exists in their system with a time on it.
- Call 911 and get a police report.
