The Recorded Statement
The first request is usually for a recorded statement. You are not obliged to give one, and there is very little upside in doing so before you know the extent of your injuries.
The questions are not neutral. “How are you feeling today?” produces “a bit better, thanks”, which becomes evidence of recovery. “Were you wearing a seat belt?” and “had you been looking at your phone?” are laying groundwork for comparative fault. An account given three days in, before imaging and before symptoms have settled, gets quoted back at you two years later.

Accepting means signing a release, and a release is final. If the shoulder that seemed like a strain turns out to need surgery, there is no reopening it. Which Policy They Are Working From
Outside New York City, rideshare runs under the state’s Transportation Network Company framework rather than TLC rules, and coverage depends on what the driver’s app was doing:
- App off — the driver’s own personal policy, often minimum limits.
- App on, awaiting a request — contingent cover, roughly $75,000 per person and $150,000 per accident.
- Ride accepted or passenger aboard — the full commercial policy at $1,250,000.
If you were a passenger, you were by definition in the third category, which is the strongest position available. If you were in another vehicle, on foot or on a bike, the period matters enormously and only the company’s own data can establish it. That is worth securing early.
The 30-Day Deadline Nobody Mentions
While all of the above is happening, a separate clock is running that the claims representative has no obligation to tell you about.
New York no-fault covers your initial medical treatment and part of your lost earnings regardless of fault — but only if the application is filed within 30 days of the accident. It is a separate process from the liability claim being discussed on the phone, and people lose it constantly while a friendly negotiation is under way.
To claim for pain and suffering you must also meet the “serious injury” threshold in Insurance Law § 5102(d) — which is proven by consistent treatment records, so gaps in care damage the claim. The lawsuit deadline is generally three years under CPLR 214, and being partly at fault only reduces recovery proportionally under CPLR 1411.
What To Do Instead
- Screenshot the trip before anything else — driver, vehicle, plate, trip ID, timestamps. Ride history is not permanent.
- Report it in the app, which timestamps the incident, but say nothing beyond the facts of what happened.
- Call 911 and get a police report.
