That is not an academic point. Commercial policies are written far above personal auto limits, and multiple defendants often means multiple policies — frequently the difference between full compensation and running out of coverage.
Whatever hit you, no-fault covers initial treatment and part of your lost earnings regardless of fault — if the application is filed within 30 days. Pain and suffering additionally requires clearing the “serious injury” threshold in Insurance Law § 5102(d), which truck-crash injuries commonly do. Partial fault reduces recovery proportionally under CPLR 1411.
