Your Police Report Comes From a City Department
Long Beach has its own police department — it is an incorporated city, not Town of Hempstead territory policed by Nassau County PD. Practically, that means your accident report is a City of Long Beach record and is requested from the City, not from the county.
It matters more than an administrative detail. If a City vehicle was involved — a police car, a public works truck, a sanitation vehicle — the claim is against the City of Long Beach, and the timetable collapses to a Notice of Claim within 90 days under General Municipal Law § 50-e, with suit inside one year and 90 days. Serving Nassau County or the Town of Hempstead instead preserves nothing.
Where Collisions Happen Here
Park Avenue is the main east-west artery through the city and carries most of the through traffic, commercial frontage and turning conflict. Broadway and West Beech Street pick up the rest, the latter with late-night traffic in season.
The crossings on and off the island — Long Beach Road, Loop Parkway, Meadowbrook, Atlantic Beach — concentrate everything into a few chokepoints, and queueing traffic at a bridge approach produces rear-end collisions in volume.
Then there is the parking problem. In summer, drivers circling for a space make abrupt stops, reverse into spaces on busy streets, and open doors into moving traffic. A door opened into a passing vehicle or cyclist is the fault of whoever opened it — not something the injured party should be talked out of.
The Visitor Driver Problem
A large share of summer traffic is people who do not know the streets, are looking for parking rather than at the road, and are frequently driving a hire car or somebody else’s vehicle.
That creates a specific practical difficulty. The registered owner, the insurer and the driver may all be different, and the driver may not live in New York. Getting complete information at the scene — license, registration, insurance card, all photographed — matters far more than it does in a collision between two neighbors.
Two Clocks, One Short
New York no-fault pays your initial medical treatment and part of your lost earnings regardless of fault, up to $50,000 under basic coverage. The application must be filed within 30 days of the accident, and medical bills generally within 45 days of treatment. This is the most commonly forfeited benefit in New York motor vehicle law.
No-fault pays nothing for pain and suffering. That requires a separate claim and requires clearing the “serious injury” threshold in Insurance Law § 5102(d) — proven through consistent treatment records, so gaps in care are the defense’s best material.
- Three years to sue a private driver — CPLR 214. Two years for wrongful death.
- 90 days where a City or public vehicle was involved.
- Uninsured and underinsured (SUM) claims — separate, usually shorter, notice requirements.
- Hit and run — MVAIC may apply, on its own terms.
Partial fault reduces recovery proportionally under CPLR 1411. It does not disqualify you, whatever an adjuster implies.
What To Do
- Call 911. Make sure a Long Beach PD report is generated and note the report number.
- Photograph license, registration and insurance card, not just the plate — particularly with an out-of-town driver.
- Be examined the same day, and describe every area that hurts, not only the worst.
- Photograph both vehicles, the road, signals and any parking situation that contributed.
- Get independent witnesses — in summer they may be visitors, so a phone number is essential.
- File your no-fault application inside 30 days.
- Give no recorded statement to the other insurer.
