Why Nassau Taxis Carry Less Than City Cabs
New York City taxis are licensed by the Taxi & Limousine Commission, which sets its own insurance requirements. Oceanside is in Nassau County, so none of that applies. Taxis here are licensed locally, at town or village level, and generally carry insurance at or near the state minimum rather than the higher figures a city medallion cab must hold.
The practical consequence is blunt. A broken hip, a surgical repair, and three months out of work will exhaust a minimum-limits policy long before your losses are covered. Establishing that the driver was at fault gets you a judgment; it does not conjure insurance that was never purchased.
So You Look for the Other Policies
This is what a taxi case actually consists of — finding every layer of coverage that touches the incident:
- The vehicle’s policy — the obvious one, and often the smallest.
- The taxi company’s own commercial policy, which may be separate from the individual vehicle’s and considerably larger.
- Another driver’s policy, where a second vehicle contributed. Two at-fault parties means two policies.
- Your own SUM coverage — supplementary uninsured and underinsured motorist protection, which applies precisely when the responsible party has too little insurance. Most people do not realize their own policy covers them as a passenger in someone else’s vehicle. It frequently becomes the largest source of recovery in these cases.
SUM claims carry their own notice deadlines, often far shorter than the three-year lawsuit limit, and they are made against your own insurer — which does not make that insurer your friend in the process.
The Standard They Are Held To
Taxis are common carriers under New York law, owing passengers a heightened duty of care in how the vehicle is driven and maintained. That is a stronger position than an ordinary negligence claim against a private motorist.
It also brings the company itself into play as a defendant — how it screens and trains drivers, how it maintains its fleet, whether it kept someone driving who should not have been. That matters, because the company is more likely than the individual driver to carry meaningful coverage.
As a Passenger, You Start From the Best Position Available
A back-seat passenger is essentially never comparatively negligent. You need not work out which driver caused the crash before claiming — pursue both and let them apportion blame between themselves.
And New York applies pure comparative negligence under CPLR 1411 regardless, so even a claimant with some share of responsibility recovers, reduced proportionally.
The Deadlines
- 30 days — no-fault application. Miss it and medical bills and wage benefits can be refused outright.
- Three years — personal injury lawsuit, under CPLR 214. Two years for wrongful death.
- 90 days — Notice of Claim where a public vehicle was involved, under General Municipal Law § 50-e, with suit within one year and 90 days.
- SUM claims — separate and usually much shorter notice requirements.
Pain and suffering additionally requires clearing the “serious injury” threshold in Insurance Law § 5102(d).
What To Do
- Photograph the license markings, company name and plate. Local taxi operators change names and vehicles; without this, tracing the right insurer months later is genuinely hard.
- Keep the receipt or booking record — it proves you were a fare-paying passenger.
- Call 911 and get a police report.

- Give no recorded statement to any insurer before speaking with a lawyer.
